97-3096 ORD ORDINANCE NO. 97-3096 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING ORDINANCE NO. 1605 AS AMENDED, WHICH ESTABLISHED POSITIONS IN THE UNCLASSIFIED SERVICE AND SALARY RANGES FOR UNCLASSIFIED EMPLOYEES, BY AMENDING SALARY RANGES FOR CHIEF DEPUTY, DEPUTY AND FIRST ASSISTANT CITY ATTORNEYS (EMPLOYED BEFORE AND AFTER OCTOBER 1, 1992), LEGAL SECRETARIES (EMPLOYED AFTER OCTOBER 1, 1992) AND PARALEGALS (EMPLOYED BEFORE OCTOBER 1, 1992); PROVIDING FOR REPEALER, SEVERABILITY AND AN EFFECTIVE DATE. BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1. AMENDMENT TO SECTION IB OF ORDINANCE NO. 1605. That Section 1 of Ordinance No. ]605 of the eity of Miami Beach is hereby amended to read as follows: SECTION 1. The following shall constitute the Compensation Plan for the offices and positions in the Unclassified Service which are hereby created or recreated in accordance with the following organization plan, and a schedule of rates of salaries by Ordinance No. 88-261 ] effective April 25, 1988 (commencement of nearest pay period to May], ] 988) for said offices and positions is hereby established. The City Manager is authorized to prescribe a compensation plan for offices and positions in the Unclassified Service; provided that any office or position hereafter created or recreated shall be authorized by an ordinance of the City Commission amending the Unclassified Salary Ordinance, and said ordinance shall not be any budget ordinance of the eity; to establish a schedule of salaries thereof that are in accordance with the budget adopted by the City Commission for that fiscal year; to provide for future cost of living increases for these positions in accordance with and at the same time as such negotiated increases are provided to members of the Miami Beach Employees Benevolent Association. Notwithstanding any other provisions of this or any other legislation, commencing with the 1995/1996 fiscal year, all salary changes for all employees in the Office of the eity Attorney shall be recommended by the eity Attorney and referred to the Commission Oversight Committee on the Office of the City Attorney before final budget approval by the City eommission. Employees of the City Attorney's Office shall continue to be Members of the Retirement System for Unclassified Employees and Elected Officials, that nothing herein amends those provisions, and that they shall retain all rights and benefits thereunder. All benefits, in addition to salary, shall be in accord with those for the unclassified executives in the City Manager's Office. SECTION 2. AMENDMENT OF SECTION IA OF ORDINANCE NO. 1605. The original contained in your package contains an omission which was caught on review. The proposed Ordinance submitted herewith reflects the following substantive changes: 1. As relates to employees whose employment commenced before October I, 1992, an increase in the upper range ofbi-weekly compensation for the classifications of Chief Deputy City Attorney, First Assistant City Attorney and Paralegal. 2. As relates to employees whose employment commenced after October 1, 1992, an increase in the upper range of bi-weekly compensation for the classification of Chief Deputy City Attorney, Deputy City Attorney, First Assistant City Attorney and Legal Secretary. The purpose of these proposed changes is to adjust compensation inequities resulting from the arbitrary demarcation date of October I, 1992, which have become apparent over the past year. At the same time it equalizes the upper ranges for Chief Deputy City Attorney and First Assistant City Attorneys whose employment commenced prior to and after October I, 1992, because there is no rationale for retaining a differentiation in those categories. The housekeeping changes simply move the locations of the classifications Office Manager and Senior Assistant City Attorney in the Ordinance to a more rational and understandable order.
