Resolution 8852 RESOLUTION NO. 8852
WHEREAS, the City Council of the City of Miami
Beach deems it to be necessary to increase to One Hundred -
Twenty-Five (125) feet the width of that portion of Collins
Avenue adjacent on the west to Lots 1, 2_, 3, 4 and 5 of
Indian Beach Corporation ' s Subdivision, according to the
Amended Plat thereof, recorded in Plat Book 8, at page 61,
of the Public Records of Dade County, Florida, and
WHEREAS, in order to increase the width of Collins
Avenue as aforesaid, it will be necessary to acquire an ease-
ment for highway purposes over, under and across those certain
unnumbered 'out-lots" lying between Collins Avenue and Indian
Creek and opposite said Lots 1, 2, 3, 4 and 5, as well as to
acquire, bulkhead and fill an additional submerged area in
Indian Creek, and
WHEREAS, the owners, long-term lessees and mortgagees
of said lands have indicated their willingness to deliver to
the City deeds conveying, quit-claiming and releasing said
unnumbered "out-lots' in consideration of the agreements to
be made by the City in connection therewith, and
WHEREAS, the City Attorney has prepared agreements
setting forth the terms and conditions upon which said owners,
lessees and mortgagees will deliver said instruments, and
WHEREAS, the City Council deems it to be to the best
interest of the City to acquire said lands on the terms and
in the manner sit forth in the agreements,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and the
City Clerk be and they are hereby authorized and directed
to execute said agreements in the name of and on behalf of
said City .
BE IT FURTHER RESOLVED that the City Manager and
the City Clerk be and they are hereby authorized and direct-
ed to carry out the terms of said agreements for and in be-
half of said City and the disbursing officers of the City be
and they are hereby authorized and directed to make such ex-
penditures as the City is obligated to make under the terms
of said agreements from the funds of said City available for
such purpose .
