Resolution 9121 RESOLUTION NO. 9121
WHEREAS, the City of Miami Beach on October 26,
1937, was granted an underground storm sewer easement by
the terms of that certain Deed recorded in Deed Book 18+1,
page 470,. of the Public Records of Dade County, Florida,
said grant being in words and figures as follows :
"Give and grant unto the City of Miami
Beach, Florida, its successors and assigns
and grantees operating public utilities,
the perpetual right and easement to lay
and maintain storm sewers, underground in
the southerly 2 1/2 feet of Lot 13, Block
1, San Marino Island, as per Plat recorded
in Plat Book 9, Page 22 of the Public Re-
cords of Dade County, Florida. "
and
WHEREAS, the owners in fee of south one-half
(1/2) of said Lot Thirteen (13) have made request that
the City of Miami Beach surrender and relinquish said
easement for and in consideration of the grant by said
owners of a like and similar easement in and to the
following described land, to-wit :
The northerly five- (5) feet of the southerly
one-half (1/2) of Lot 13, Block 1, San Marino
_ Island, according to the Plat thereof, record-
ed in Plat Book 9, page 22, of the Public Re-
cords of Dade County, Florida.
and
WHEREAS, the owners have agreed that the cost of
reconstructing and replacing the existing storm sewer in
and to the new proposed easement shall be borne exclusively
by said Owners, and
WHEREAS, the City Council of the City of Miami Beach
deems it to be to the best interests of the City that the said
exchange of easements be effectuated, and
WHEREAS, the City Attorney has prepared an agreement
by the terms of which the City surrenders the existing easement
in consideration of the grant of the new easement herein- des-
cribed, and for the further consideration,.'that the reconstruct-
ion and replacement of the existing sewer shall be at the sole
cost and expense of the owners, and with which agreement the
City Council is familiar,
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Miami Beach that the Mayor and the City Clerk
be and they are hereby authorized to execute said agreement

and the Deed therein described for and on behalf of the City
of Miami Beach and that upon the fulfillment and performance
of the conditions set forth in said agreement, the delivery
of said Deed surrendering said easement to the owners shall
thereupon be duly authorized.
