2016-29550 Reso RESOLUTION NO. 2016-29550 A RESOLUTION OF THE MAYOR AND THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE CITY MANAGER TO EXTEND THE AGREEMENT WITH THE ERIC RYAN CORPORATION, DATED JULY 17, 2016, FOR TELECOMMUNICATION AUDIT SERVICES, ON A MONTH-TO-MONTH BASIS, UNTIL COMPLETION OF THE ERIC RYAN CORPORATION'S OBLIGATIONS UNDER THE AGREEMENT, FOR A PERIOD NOT TO EXECEED ONE (1) YEAR COMMENCING ON NOVEMBER 14, 2016, WHICHEVER OCCURS FIRST. WHEREAS, Request for Proposal No. 2015-126-LR (the RFP) for telecommunication audit services was issued on March 12, 2015 with an opening date of April 10, 2015; and WHEREAS, the City received proposals from the following seven (7) entities: BTU Consultants, LLC; Communications Brokers, Inc. dba/CBI Telecommunications Consultants, The Eric Ryan Corporation; Espy Services, Inc.; S2K Consulting, Inc.; Telanalysis, LLC; and Troy & Banks, Inc.; and WHEREAS, on May 6, 2015, the City Commission adopted Resolution No. 2015-29006 awarding the agreement to The Eric Ryan Corporation; and WHEREAS, on July 17, 2015 the City entered into an Agreement with The Eric Ryan Corporation for Telecommunications Audit Services pursuant the RFP; and WHEREAS, the original one (1) year agreement term with The Eric Ryan Corporation for Telecommunications Audit Services expired on July 17, 2016; and WHEREAS, pursuant to the Agreement, the City may extend the contract past the stated termination date for a period of up to 120 days and the City has extended the Agreement for 120 days through November 13, 2016; and WHEREAS, the City Manager is requesting authorization to extend the Agreement with The Eric Ryan Corporation, on a month-to-month basis beyond the 120 day period, until completion of contractual obligations or until November 15, 2017, whichever occurs first, which shall be terminable by the City for convenience, and without cause, upon thirty (30) days written notice to The Eric Ryan Corporation. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby authorize the City Manager to extend the Agreement with The Eric Ryan Corporation, dated July 17, 2016, for telecommunications audit services, on a month-to-month basis, until completion of the contract obligations under the agreement, for a period not to exceed one (1) year commencing on November 14, 2016, whichever occurs first. Morales, City Manager DATE: September 14, 2016 SUBJECT: A RESOLUTION OF THE MAYOR AND THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE CITY MANAGER TO EXTEND THE AGREEMENT WITH THE ERIC RYAN CORPORATION, DATED JULY 17, 2016, FOR TELECOMMUNICATION AUDIT SERVICES, ON A MONTH-TO- MONTH BASIS, UNTIL COMPLETION OF THE CONTRACTOR OBLIGATIONS UNDER THE AGREEMENT, FOR A PERIOD NOT TO EXECEED ONE (1) YEAR COMMENCING ON NOVEMBER 14, 2016, WHICHEVER OCCURS FIRST. RECOMMENDATION The Resolution is approved. ANALYSIS In July of 2015, the City of Miami Beach entered into a one (1) year Agreement with Eric Ryan Corporation. Eric Ryan is to perform a review of the City's telecommunications accounts with the purpose of recovering erroneous payments and to provide recommendations to the City for reducing the coast of the relates services. The City currently uses telecommunication services provided by AT&T—under the master agreement for telephone lines, circuit lines, DSL connections and for Wide Area Network(WAN) circuits that provide services to over 33 buildings and facilities throughout the City. The City has approximately 1170 phone lines, 65 circuit lines, and five (5) DSL connections. Currently, the City average monthly cost for these services is $141,000. A telecommunications audit has not been performed in over approximately thirteen (13)years. Due to delays in the start of the project and third party dependencies, the vendor was not able to complete the project by expiration date of July 17, 2016. The Agreement, along with the RFP Section 31 Contract Extension of the RFP, the City reserves the right to require the Contractor to extend contract past the stated termination date for a period of up to 120 days. A month-to- month extension of the Agreement is proposed until completion of contractual obligations. CONCLUSION The City Manager recommends that the Mayor and the City Commission authorize the month-to- month extension of the existing Agreement with Eric Ryan Corporation.
