2016-29646 Reso RESOLUTION NO. 2016-29646 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE CITY MANAGER TO APPROPRIATE FUNDS IN THE AMOUNT OF $290,757, AS PROVIDED FOR UNDER THE UTILITY DESIGN CONSTRUCTION CONTRACT WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION (FDOT), AS APPROVED UNDER RESOLUTION 2016-29391, WHICH CONTRACT PROVIDES FOR FDOT'S DESIGN OF CITY-OWNED UTILITIES THAT REQUIRE RELOCATION, AS PART OF FDOT'S STATE ROAD (S.R.) 907/ALTON ROAD PROJECT FROM MICHIGAN AVENUE TO 43RD STREET (FM # ID 429193-1-56-01). WHEREAS, on May 16, 2016, the City under Resolution 2016-29391, executed a Utility Design Construction Contract and Third Party Escrow Agreements with FDOT to develop engineering plans for the relocation of and upgrades to City-owned utility facilities as part of the Florida Department of Transportation (FDOT) project to construct certain infrastructure improvements on Alton Road/State Road (S.R.) 907 from Michigan Avenue to 43rd Street (the FDOT Project); and WHEREAS, the FDOT Project will require the design and construction of roadway reconstruction, intersection improvements, milling and resurfacing, adjustment of valves and manholes, sidewalk and curb ramps, signing and pavement markings signalization improvements, drainage improvements including the construction of two (2) pump stations on Alton Road; and WHEREAS, the FDOT Project will impact existing City-owned utility facilities along Alton Road; and WHEREAS, the FDOT Project requires the relocation of the impacted City-owned utility facilities; and WHEREAS, under the May 16, 20016, agreement FDOT designed the utility relocation work by the engineer designing the FDOT Project; and WHEREAS, the City's Public Works Department received the cost proposals from Stantec, the FDOT engineer/consultant, in the amount of $209,757, to complete the utility location re-design; and WHEREAS, after negotiations with Stantec, Public Works has reviewed the cost proposal and deemed same acceptable for the scope of work; and WHEREAS, pursuant to the May 16, 2016 Utility Design Construction Contract, the City is to deposit pursuant the Third Party Escrow Agreement the funds necessary to cover the engineering/consultant work relating to relocating the City's utilities; and WHEREAS, based upon Florida contracting rules, the underlying Utility Design Construction Contract, and the review of Public Works of the scope of services, the City Manager recommends appropriating the funds to complete the designated scope of work. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby approve and authorize the City Manager to appropriate funds in the amount of$290,757, as provided for under the Utility Design Construction Contract with the Florida Department Of Transportation (FDOT), as approved under Resolution No.: 2016-29391, which contract provides for FDOT's design of City-owned utilities that require relocation, as part of FDOT's State Road 907/Alton Road Project from Michigan Avenue to 43rd Street(FM# id 429193-1-56-01). RECOMMENDATION The Administration recommends that the Mayor and City Commission approve and authorize the City Manager to appropriate funds in the amount of $290,757 for the Utility Design by FDOT Consultant Agreement with the FDOT. ANALYSIS The Florida Department of Transportation (FDOT) is planning to construct improvements on Alton Road/SR 907 from North Michigan Avenue to 43rd Street (Project). Construction is scheduled to begin in April 2020. The Project will include roadway reconstruction, intersection improvements, milling and resurfacing, adjustment of valves and manholes, sidewalk and curb ramps, signing and pavement markings and signalization improvements, and drainage improvements including the construction of two storm water pump stations. The Project will impact existing City-owned utilities on Alton Road. As such, the impacted utilities require relocation. The design of the City-owned utilities relocation and upgrades by the engineer designing the project for FDOT requires the execution of a Utility Design Consultant Agreement between FDOT and the City. On May 11th, 2016, City Commission via Resolution No. 2016-2931, approved and authorized the City Manager to execute both the Utility Design Consultant and the Third Party Escrow Agreements in order to provide for the implementation of the necessary roadway reconstruction, intersection improvements, milling and resurfacing, adjustment of valves and manholes, sidewalk and curb ramps, signing and pavement markings, signalization improvements, and drainage improvements including the construction of two pump stations along Alton Road/S.R. Page 607 of 906 907 from North Michigan Avenue to 43rd Street, as part of the project (FM No. 429193-1-56- 01). These agreements stipulate that the engineering consultant designing the Project for FDOT will be responsible for the design of the City-owned utilities, including relocation and upgrades to be constructed as part of the project. The design fees shall be funded by the City of Miami Beach. The FDOT Consultant shall be responsible for the design of all utility work, including location (vertically and horizontally), protection, relocation, installation, adjustment, or removal of utilities owned by the City of Miami Beach that are affected by the project. The Public Works Department received from Stantec (FDOT Consultant) a cost proposal to complete the design. The total cost of the Design is $290,757. The Department of Public Works has reviewed the proposal and deemed it acceptable for the work included. CONCLUSION The Administration recommends that the Mayor and City Commission approve and authorize the City Manager to appropriate funds in the amount of $290,757 for the Utility Design by FDOT Consultant Agreement with the FDOT.
