2016-29681 Reso RESOLUTION NO. 2016-29681 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE RECOMMENDATION OF THE FINANCE AND CITYWIDE PROJECTS COMMITTEE AND TRANSPORTATION, PARKING AND BICYCLE-PEDESTRIAN FACILITIES COMMITTEE TO EXPAND PARKING INVENTORY IN THE BISCAYNE BEACH NEIGHBORHOOD AND FUND THE DESIGN OF A PARKING GARAGE LOCATED AT 8100 HAWTHORNE AVENUE, SUBJECT TO A CAPITAL BUDGET AMENDMENT. WHEREAS, on September 14, 2016, the Mayor and City Commission approved the referral of Item R9S to the Neighborhoods and Community Affairs Committee (NCAC) for discussion and direction based upon input and comments from the residents of Biscayne Beach and their request for additional parking opportunities in their neighborhood; and WHEREAS, on September 16, 2016, the NCAC discussed the issue and heard public comment from Biscayne Beach residents as well as the options to enhance parking; and WHEREAS, since these options have financial impacts, on October 19, 2016, the Mayor and Commission approved Item No. C4C, a referral of the Biscayne Beach parking issue to the Finance and Citywide Projects Committee (FCWPC) and to the Transportation, Parking and Bicycle-Pedestrian Facilities Committee (TPBPFC); and WHEREAS, parking demand in Biscayne Beach is mostly attributed to the density in the neighborhood and related vehicle to household ratio, particularly for the multi-unit residences; and WHEREAS, although there are no entertainment/commercial districts within the vicinity of Biscayne Beach, there is potential parking intrusion as a result of short term rentals; however, this is tempered with the fact these properties may legally serve as residential properties generating equal or greater parking demand, therefore the net effect is presumably negligible; and WHEREAS, the Administration developed several alternatives to increase parking inventory in the Biscayne Beach neighborhood, including restriping of the roadway to recapture up to 25 curbside parking spaces at a nominal expense; relocation of fire hydrants that may recapture up to 14 parking spaces at an estimated cost of $200,000; and development of a parking garage with up to 70 parking spaces at an estimated cost of$2MM; and WHEREAS, on October 28, 2016, the FCWPC discussed the item and made the following recommendations: • moving forward with the Biscayne Beach garage and that the City Commission add it to the previously authorized design criteria professional's pool of garages; and • moving forward with the restriping to gain up to an additional 25 parking spaces and expanding the scooter implementation program to Biscayne Beach to gain 20-30 motorcycle/scooter spaces as an interim solution; and • directing staff to further explore the relocation of the fire hydrants; to refer a discussion item to the Parking and Transportation Committee, to have them compare the plan that staff provided to the homeowners' and to provide the maximum amount of spaces to be gained; and to bring back this item to FCWPC for further consideration; and WHEREAS, on Monday, November 7, 2016, the TPBPFC discussed the item and recommended the following to staff: • to proceed with the restriping plan to gain additional parking in the neighborhood; and • to meet with the City's Capital Improvement Projects Department, Fire Department, Parking Department and Biscayne Beach Home Owners Association to discuss possible parking enhancements related to fire hydrant relocations and to return to the TPBPFC with the results; and WHEREAS, on October 28, 2016, the FCWPC discussed funding sources for the potential parking garage project for the aforementioned Biscayne Beach neighborhood and considered the following: 1. $10.5MM owed to the City by "8701" Collins Ave Development, LLC, due in payments as follows: • $1 MM paid to the City; • $4.5MM is due on November 19, 2016; • $1.25MM by May 19, 2017; • $1.25MM by November 19, 2018; • $1.25MM by May 19, 2018; and • $1.25MM by November 19, 2019; and 2. $6.7MM identified to fund improvements in North Shore Open Space Park; and 3. the balance of approximately $2.8MM which could be funded from the Pay In Lieu of Parking Fund for North Beach. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby accept the recommendation of the Finance and Citywide Projects Committee and Transportation, Parking and Bicycle-Pedestrian Facilities Committee to expand parking inventory in the Biscayne Beach neighborhood and fund the design of a parking garage located at 8100 Hawthorne Avenue, subject to a capital budget amendment. RECOMMENDATION Accept the Resolution. ANALYSIS On September 14, 2016, the Mayor and City Commission approved the referral of Item R9S to the Neighborhoods and Community Affairs Committee (NCAC) for discussion and direction. The Mayor and Commission held a brief discussion on the item with input and comments from the residents of Biscayne Beach and their request for the City to provide additional parking opportunities in their neighborhood. This discussion led to the aforementioned referral to the NCAC. On September 16, 2016, the NCAC discussed the issue and heard public comment from Biscayne Beach residents as well as the aforementioned options to enhance parking. The administration presented a potential funding mechanism for the construction of a parking garage on this site with a a pro rata assessment of each folio within the Biscayne Beach neighborhood, defined as 86th Street to the north; 79th Street to the south; Hawthorne Avenue to the west; and Crespi Boulevard to the east.A parking garage with an estimated 70 parking spaces, at a cost of $25,000 per space, equates to an estimated project construction cost of $1.8M. There are 489 folios, including single family homes (231) and multi-unit residences (258) within the aforementioned boundaries. This equates to an assessment of $3,700 for each folio. This assessment could be extended over five (5) years resulting in an annual assessment of $740 per folio (assessment could be refined further to the square footage per folio).These options have financial impacts including a potential special assessment to each property in the Biscayne Beach neighborhood; however, residents who attended the NCAC meeting and spoke were not in favor of a special assessment. Please note if funded through monthly parking permits, this Page 894 of 1191 would certainly be a costlier alternative to residents at $75 per month ($900 annually). This revenue stream would not be assured if residents choose to not utilize/purchase monthly permits. Neither of these two funding options funding option was supported by either Biscayne Beach residents or the FCWPC: The NCAC requested that the Administration explore the use of monies from the "8701" Collins Ave Development, LLC, that may potentially serve as a funding source. Of the $10.5MM owed by"8701", the City has received a $1 MM payment and the following payments are due: • $4.5MM is due on November 19, 2016; • $1.25MM by May 19, 2017; • $1.25MM by November 19, 2018; • $1.25MM by May 19, 2018; • $1.25MM by November 19, 2019 On November 19, 2014, the Mayor and Commission approved Resolution No. 2014-28839 approving a not to exceed amount of $6.69MM to fund improvements in North Shore Open Space Park, leaving a balance of approximately $3.81 MM which could be used to fund these parking initiatives in the Biscayne Beach neighborhood, including a parking garage, subject to timing of funds. On October 19, 2016, the Mayor and Commission approved Item No. C4C, acccepting the NCAC to refer the Biscayne Beach Parking issue to the Finance and Citywide Projects Committee (FCWPC). The item was also referred to the Transportation, Parking and Bicycle- Pedestrian Facilities Committee (TPBPFC). It is important to note parking demand in Biscayne Beach is mostly attributed to the density in the neighborhood and related vehicle to household ratio, particularly for the multi-unit residences. There are no entertainment or commercial districts within the vicinity of Biscayne Beach that would reasonably result in displacement of resident parking spaces. There is potential parking intrusion as a result of short term rentals; however, this is tempered with the fact these properties may legally serve as residential properties generating equal or greater parking demand. The net effect is presumably negligible. Please further note a streetscape project was completed by the CIP Department in 2013. The initial design of the curbside parking had an approximate loss of 131 compliant curbside parking spaces. At the time, the CIP, Fire, and Parking departments coordinated a review of this layout and were able to return approximately 137 curbside parking spaces to the neighborhood. Option 1 — Restripe Spaces and Relocate Fire Hydrants Increase parking spaces by restriping segments of the existing parking layout which would result in 25 additional parking spaces at a nominal expense funded by parking department operations. Additionally, the relocation of fire hydrants may yield as many as 14 additional parking spaces at an estimated expense of $200,000 potentially funded by either monies due from the 8701 Collins Avenue development project or pay in lieu of fund for North Beach. Option 2—Construct a Parking Garage The City owns the parcel located at 8100 Hawthorne Avenue. Currently, it houses a storm water pump station on a portion of the property and the balance of the property is vacant. Public Works has new pump station programmed in the Capital Budget for FY 18/19. It is important to Page 895 of 1191 note the pump station must retain unobstructed overhead access for installation, maintenance, and removal. The property size for the City's parcel is 17,483 square feet and the site zoned GU (Government Use) is located at the northwest corner of Hawthorne Avenue and 81st Street. The CIP (Capital Improvement Projects) Department analysis revealed that construction of a parking garage will be feasible on the north end of the site, on an area approximately 90'x120'. Access to the garage will be provided from 81st Street, west of Hawthorne Avenue. It is estimated that 15-18 parking spaces can be accommodated per floor. In order to match nearby buildings, we assumed no more than a four level structure (approximately 40' high). As such, it is estimated that approximately a total of 70 parking spaces could potentially be accommodated in this structure. Assuming a cost per space of $25,000 for a garage with a conservative design/facade is estimated to cost$1.8M. FCWPC and TPBPFC - Recommendations On October 28, 2016, the FCWPC discussed the item and took the following actions: • The Committee recommended moving forward with the design of the Biscayne Beach garage and directing it to the City Commission to add it to the previously authorized design criteria professional's pool of garages to be worked on. The Committee further recommended that monies from the "8701" Collins Ave Development, LLC, serve as a funding source for the $180,000 (10% of estimated project cost) needed for design of the project, subject to a capital budget amendment . Funding for the construction could be considered as part of the FY 2017/18 capital budget development process. • The Committee recommended moving forward with the restriping to gain up to an additional 25 parking spaces and expanding the scooter implementation program to Biscayne Beach to gain 20-30 motorcycle/scooter spaces as an interim solution. Together with spaces previously recaptured, the 20-30 spaces would address all spaces previously lost by the CIP project. • The Committee directed staff to further explore the relocating of the fire hydrants and, to send to the Parking and Transportation Committee to have them compare the plan that staff provided to the homeowners' study and come up with an agreement of the max amount of spaces to be gained and bring back this item to Finance Committee meeting to make a decision based on the agreement. On Monday, November 7, 2016, the TPBPFC discussed the item and recommended the following to staff: • Proceed with the restriping plan to gain additional parking in the neighborhood. • Meet with CIP Department, Fire Department, Parking Department and Biscayne Beach HOA to discuss possible parking enhancements related to fire hydrant relocations and return to the TPPBFC with the results. Funding Considerations While pursuant to Resolution No. 2014-28839 approving an amount not to exceed $6.69MM from the "8701" Collins Ave Development, LLC, this funding will come in over time and only $5.75MM is anticipated to be received in Fiscal Year 2016/17. As such there is no excess funding in FY 2016/17 for the $180,000 required for design. If the City Commission desires to move forward with the design of the project during FY 2016/17, funds would need to be advanced from some other source. It should also be noted that the full master plan for North Shore Open Space Park will likely Page 896 of 1191 exceed the $6.7MM allocated to the project and the remaining funds could be used for that as well. CONCLUSION The attached resolution accepts the FCWPC recommendations moving forward with the design of the Biscayne Beach garage and directing it to the City Commission to add it to the previously authorized design criteria professional's pool of garages to be worked on with funding subject to a Capital Budget amendment; move forward with the restriping of the parking layout to gain up to an additional 25 parking spaces; and further explore the relocation of fire hydrants.
