2016-29664 Reso RESOLUTION NO. 2016-29664 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE RECOMMENDATION OF THE CITY MANAGER TO REJECT ALL PROPOSALS RECEIVED, PURSUANT TO REQUEST FOR PROPOSALS (RFP) NO. 2016-046-KB, RED LIGHT VIOLATION CAMERA ENFORCEMENT SYSTEM AND RELATED SUPPORT SERVICES. WHEREAS, Request for Proposal (RFP) No. 2016-046-KB was issued on February 16, 2016, and had an opening date of July 14, 2016; and WHEREAS, a pre-proposal conference was held on March 2, 2016; and WHEREAS, the City received a proposal from American Traffic Solutions, Inc., Brekford Corp., Gatso USA, Inc., Redflex Traffic Systems, Inc., Sensys America, Inc., and Xerox State & Local Solutions, Inc. in response to the RFP 2016-046-KB; and WHEREAS, the Committee convened on September 8, 2016 to consider the six (6) proposals; and WHEREAS, the Committee was provided an overview of the project, information regarding the City's Cone of Silence Ordinance and the Government Sunshine Law, general information on the scope of services, references and a copy of each proposal; and WHEREAS, the Committee was instructed to score and rank the proposals pursuant to the evaluation criteria established in the RFP; and WHEREAS, the Committee's ranking was as follows: (1) Gatso USA, Inc. (2) Redflex Traffic Systems, Inc. (2) Xerox State & Local Solutions, Inc. (4) Sensys America, Inc. (5) American Traffic Solutions, Inc.; and (6) Brekford Corp. WHEREAS, the City Manager has reviewed the proposals received, as well as the Evaluation Committee's process, and recommends the rejection of all proposals for the following reasons: (1) The record of the Evaluation Committee meeting indicates that at least half of the Committee members had not fully considered the proposals, and were not sufficiently prepared for the Evaluation Committee meeting, implicating concerns with respect to the underlying fairness of the review process; and (2) The City has recently commenced pursuing its interest in utilizing "Smart City" technology, which integrates various governmental services, including transportation, traffic management, public works and public safety systems through innovative technology systems. The Administration must re-evaluate the RFP technical specifications of the red light cameras system to ensure that such "Smart City" technology options are properly incorporated, which will require the City to re- advertise the RFP with these technical specifications ("Smart City" technology) in order to best serve the City's interests, goals and objectives; and (3) The City must re-advertise the RFP specifications with those technical services that the City currently desires to procure for its red light camera system, which must include the City's position with regard to various contractual terms, conditions and requirements. The re-advertisement of the RFP will permit the City to further clarify, which shall include clear and unequivocal language regarding liability and indemnification language, to avoid receiving proposals that take material exceptions to the City's terms and conditions set forth within the RFP. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby approve the Resolution accepting the recommendation of the City Manager to reject all proposals received, pursuant to Request for Proposals No. 2016-046-KB for the Red Light Camera Enforcement System and Related Support Services, and further authorize the City Administration to issue a new RFP for red light camera enforcement system and related support services. Morales, City Manager DATE: December 14, 2016 SUBJECT: A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE RECOMMENDATION OF THE CITY MANAGER TO REJECT ALL PROPOSALS RECEIVED, PURSUANT TO REQUEST FOR PROPOSALS (RFP) NO. 2016-046-KB, RED LIGHT VIOLATION CAMERA ENFORCEMENT SYSTEM AND RELATED SUPPORT SERVICES. RECOMMENDATION Adopt the Resolution. ANALYSIS On December 10, 2008, the Mayor and City Commission enacted Ordinance No. 2008 3621, creating Article XI entitled "Dangerous Intersection Safety' of Chapter 106 of the Miami Beach Code, entitled "Traffic and Vehicles". This provision authorizes the enforcement of red light infractions through the utilization of an automated image capture technology in an effort to reduce traffic crashes and resulting injuries. In the interest of public safety, the City's Administration has monitored the use of this technology for several years before pursuing this type of enforcement program. Installation of this system consists of a camera, strobe and two lasers mounted on a metal pole near an intersection with a traffic light. This equipment is designed to monitor the traffic light signal phases and upon the light turning red any vehicle proceeding into the intersection without stopping will be photographed and captured on video. The images are then electronically forwarded to the vendor reviewed for quality and then sent to a Miami Beach Police Department (MBPD) employee for review to ensure an infraction has taken place. After these reviews have taken place an infraction notice is then sent to the violator via United States Mail. Pursuant to the RFP, the City of Miami Beach requested proposals from qualified vendors to enter into a contract for the delivery and maintenance of unmanned cameras/monitoring devices also known as traffic control signal monitoring system for red traffic light violations with a vendor capable of a turnkey solution for design, implementation and maintenance. The successful vendor will provide for the appropriate hardware and administrative support to ensure a credible and reliable electronic camera recording system. The traffic control signal monitoring system will have the capability when utilizing one or more sensors to work in conjunction with a traffic control signal, still camera and video recording device, to capture and produce recorded images of motor vehicles entering into an intersection against a steady red light signal. The cameras will be Page 389 of 1191 installed by the vendor at no cost to the City of Miami Beach at traffic intersections at the direction of representatives of the Miami Beach Police Department. RFP PROCESS On February 16, 2016, The RFP was issued, with an opening date of July 14, 2016. A pre- proposal conference to provide information to the proposers submitting a response was held on March 2, 2016. The City received proposals in response to the RFP from the following six (6)firms: • American Traffic Solutions, Inc. • Brekford Corp. • Gatso USA, Inc. • Redflex Traffic Systems, Inc. • Sensys America, Inc. • Xerox State & Local Solutions, Inc. On August 1, 2016, the City Manager appointed the Evaluation Committee via LTC #327-2016. The Evaluation Committee convened on September 8, 2016 to consider proposals received. However, Mr. Richard Hull, Resident of the City of Miami Beach, was unable to participate as an evaluation committee member. The Committee was provided an overview of the project, information relative to the City's Cone of Silence Ordinance and the Government Sunshine Law. The Committee was also provided with general information on the scope of services, references, and a copy of each proposal. The Committee was instructed to score and rank each proposal pursuant to the evaluation criteria established in the RFP. The evaluation process resulted in the ranking of proposers as indicated in Attachment A. After the Evaluation Committee, staff further reviewed the proposals received for responsiveness. The due diligence review of staff resulted in a determination that the proposal from Xerox State & Local Solutions, Inc. was non-responsive for failure to submit Appendix E, Cost Proposal Form, in its entirety and fully executed by the deadline established for the receipt of proposals.Additionally, proposals received from American Traffic Solutions, Inc., Gatso USA, Inc., and Xerox State & Local Solutions, Inc. included significant exceptions to the City's special conditions set forth in the RFP. CONCLUSION The City Manager has reviewed the proposals received, as well as the Evaluation Committee's process, and finds as follows: (1) the record of the Evaluation Committee meeting indicates that at least half of the Committee members had not fully considered the proposals, and were not sufficiently prepared for the Evaluation Committee meeting, implicating concerns with respect to the underlying fairness of the review process; and (2) in addition to ensuring that the RFP is re-advertised with technical specifications that reflect the services the City currently desires to procure, the City should re- advertise updated RFP specifications that clarify the City's position with regard to various terms and conditions, including with respect to liability and indemnification, to avoid receipt of proposals that take material exceptions to the City's terms and conditions; and (3) in light of the City's recent interest in pursuing "Smart City" technology delivery Page 390 of 1191 approaches, i.e., through technology that integrates various governmental services, including transportation, traffic management, public works and public safety systems, the Administration should re-evaluate the RFP technical specifications for red-light cameras in the context of such "Smart City' technology options, to permit the City to readvertise an RFP with the technical specifications that will best serve the City's interests. After considering the proposals received and the results of the evaluation committee, the City Manager recommends that the Mayor and City Commission of the City of Miami Beach, Florida approve the Resolution rejecting all proposals, pursuant to Request for Proposals No. 2016- 046-KB for a Red Light Camera Enforcement System and Related Support Services, and further authorize the City Administration to issue a new RFP for red light camera enforcement system and related support services.
