2016-29671 Reso RESOLUTION NO. 2016-29671 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING THE ACCEPTANCE OF $13,027 OF STATE HOUSING INITIATIVES PARTNERSHIP (SHIP) FUNDS FOR THE PURPOSE OF PROVIDING HOUSING COUNSELING SERVICES FOR HOMEOWNERS AND PROSPECTIVE HOMEBUYERS; AUTHORIZING THE APPROPRIATION OF THE FUNDS AS AN ADDITION TO THE FISCAL YEAR 2016/2017 SHIP ALLOCATION; AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO EXECUTE ANY AND ALL DOCUMENTS OR AGREEMENTS IN CONNECTION WITH THE FUNDING ALLOCATION, AND TO SUBMIT THEM TO THE FLORIDA HOUSING FINANCE CORPORATION (FHFC); AND FURTHER AUTHORIZING THE APPROPRIATION OF ANY INTEREST ACCRUED THEREON FOR ELIGIBLE HOUSING COUNSELING SERVICE ACTIVITIES UNDER THE SHIP PROGRAM RULES. WHEREAS, the State of Florida enacted the William E. Sadowski Affordable Housing Act, Chapter 92-317 of Florida Sessions Laws, allocating a portion of documentary stamp taxes on deeds to local governments for the development and maintenance of affordable housing; and WHEREAS, the State Housing Initiatives Partnership (SHIP) Act, §§ 420.907-420.9079, Florida Statutes (1992), and Rule Chapter 67-37, the Florida Administrative Code, require local governments to develop a three-year Local Housing Assistance Plan (LHAP) outlining how funds will be used; and WHEREAS, the City receives annual entitlement funds allocations from the State of Florida SHIP Program for the purpose of developing and maintaining affordable owner-occupied and renter-occupied properties; and WHEREAS, the Florida Housing Finance Corporation (FHFC) is the entity that administers the SHIP Program for the State of Florida; and WHEREAS, FHFC notified the City of an additional allocation of $13,027 for FY 2016/2017, to be used to provide homeowners and prospective homebuyers with housing counseling; and WHEREAS, the funds are not automatically disbursed to the City; and WHEREAS, The City must submit a request and certification to FHFC to receive the distribution of the funds; and WHEREAS, the Administration recommends that the request and certification be submitted to FHFC so that the funds can be disbursed and utilized to enhance the services provided under the homebuyer/homeowner programs. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby approve the acceptance of$13,027 of State Housing Initiatives Partnership (SHIP) funds for the purpose , of providing housing counseling services for homeowners and prospective homebuyers; authorize the appropriation of the SHIP funds as an addition to the fiscal year 2016/2017 allocation; authorize the City Manager or his designee to execute any and all documents or agreements in connection with the funding allocation, and to submit them to the Florida Housing Finance Corporation (FHFC); and further authorize the appropriation of any interest accrued thereon for eligible housing counseling service activities under the SHIP Program rules. RECOMMENDATION The Administration recommends approving the Resolution. ANALYSIS The State Housing Initiatives Partnership Program (SHIP), administered through the Florida Housing Finance Corporation (FHFC), was established in 1992 by the William E. Sadowski Affordable Housing Act to stimulate the production of affordable housing statewide. SHIP Program funds are derived from documentary stamp levies on real estate transactions, and held in the SHIP Program Trust Fund.Annually, FHFC allocates SHIP program funds among participating jurisdictions on a formula basis. Those funds are automatically disbursed to the individual jurisdictions and serve to increase access to affordable housing for income-eligible participants. Entitlement communities receiving SHIP funds are required to produce and file a Local Housing Assistance Plan (LHAP) which governs each community's use of SHIP funds. A new LHAP must be filed every three years. The LHAP delineates the strategies that will be employed to increase the availability of affordable housing for income-eligible residents within the jurisdiction. FHFC notified the City of an additional allocation of $13,027 for FY 2016/2017, to be used to Page 458 of 1191 provide homeowners, and prospective homebuyers, with housing counseling services. These funds are available as a result of actions approved as part of the housing bill passed by the 2016 Florida Legislature. The funds can be used for the following purposes: • First-time homebuyer counseling • Foreclosure prevention counseling • Financial coaching • Financial management education • Extended financial management Unlike the regular annual program allocations, these funds will not be automatically disbursed to the participating jurisdictions. Instead, the jurisdictions must submit a request and certification to FHFC to receive the disbursement. SHIP's specific expenditure guidelines have posed challenges in our community. The ability to serve very low- and low-income households in our strong real estate market has made it difficult to match eligible households with current market units. This situation is further complicated by many first-time homeowner households being unfamiliar with the requirements and responsibilities of homeownership, including the purchase process, the maintenance of a home, and the prevention of the possible loss of a home through foreclosure. The proposed funding will provide the City with the opportunity to enhance its affordable housing programs by identifying and preparing potential homebuyers that would otherwise not participate due to the lack of knowledge of available purchase opportunities or poor financial planning and management. Therefore, the administration is proposing that the new funds be accepted and the City establish a housing counseling program (or series of programs)that will allow the delivery of the services identified by the State. This will provide additional opportunities for the City to provide affordable housing assistance and to comply with SHIP Program requirements. CONCLUSION The Administration recommends approving the acceptance of $13,027 of State Housing Initiatives Partnership (SHIP)funds for the purpose of providing housing counseling services for homeowners and prospective homebuyers; authorizing the appropriation of the funds as an addition to the fiscal year 2016/2017 SHIP allocation; authorizing the City Manager, or his designee, to execute any and all documents or agreements in connection with the funding allocation and submitting them to the Florida Housing Finance Corporation (FHFC); and further authorizing the appropriation of any interest accrued thereon for eligible housing counseling service activities under the SHIP program rules.
