A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, SUPPORTING TRANSPORTATION INITIATIVES
INTENDED TO REDUCE TRAFFIC CONGESTION AND REDUCE THE NUMBER
OF VEHICLES THAT USE THE MACARTHUR CAUSEWAY TO ACCESS MIAMI
BEACH, INCLUDING SHORT-TERM INITIATIVES SUCH AS MIAMI-DADE
COUNTY'S ("COUNTY") BUS EXPRESS RAPID TRANSIT SERVICE, AND
LONG-TERM TRAFFIC REDUCTION PROJECTS, SUCH AS THE COUNTY'S
DEVELOPMENT OF A LIGHT RAIL/MODERN STREETCAR ACROSS THE
MACARTHUR CAUSEWAY TO LINK THE CITIES OF MIAMI BEACH AND MIAMI
("BEACH CORRIDOR PROJECT"); AND REQUIRING FORMAL ACTION BY
THE MIAMI-DADE COUNTY BOARD OF COUNTY COMMISSIONERS WITH
RESPECT TO THE COUNTY'S BEACH CORRIDOR PROJECT AND THE
CONNECTION ACROSS THE MACARTHUR CAUSEWAY, PRIOR TO CITY
COMMISSION APPROVAL OF ANY INTERIM AGREEMENT FOR THE MIAMI
BEACH LIGHT RAIL/MODERN STREETCAR PROJECT; AND FURTHER
REQUIRING APPROVAL OF ANY FINAL COMPREHENSIVE AGREEMENT BY A
MAJORITY OF THE VOTERS VOTING IN A CITY-WIDE REFERENDUM.
WHEREAS, in July, 2016, the Mayor and City Commission endorsed moving forward with
the environmental analysis for the Miami Beach Light Rail/Modern Streetcar Project ("City
Project"), a major transportation initiative intended to reduce traffic congestion and gridlock in the
City of Miami Beach, the scope of which contemplates a public-private partnership with a
developer, pursuant to Section 255.065 of the Florida Statutes, for a fully "turn-key" delivery
approach that includes the design, construction, financing, operation, and maintenance of the City
Project, including vehicles and associated power, communications, signalization, and other
systems, operation and maintenance facilities, and related civil infrastructure and services; and
WHEREAS, at the July 13, 2016 City Commission meeting, the Mayor and City
Commission approved the final qualifications-based ranking of proposers for the City Project, and
authorized negotiations for an Interim Agreement with the top-ranked proposer, Greater Miami
Tramlink Partners ("GMTP"); and
WHEREAS, the Interim Agreement between the City and GMTP, if approved by the
Mayor and City Commission, will provide for commencement of development activities and will
establish the process and timeline for obtaining and negotiating a comprehensive agreement and a
fixed price for delivery of the City Project; and
WHEREAS, the Interim Agreement requires GMTP to proceed with all work during the
Interim Agreement phase at its sole cost and expense, and provides both the Developer and the
City with the ability to terminate the Interim Agreement for convenience at any time, without
restriction or penalty; and
WHEREAS, capital costs for the City Project are preliminarily estimated at $245 million
(including costs for Phase 1 and the Vehicle Systems Maintenance and Operating Facility), and
annual operating costs are estimated at $7 million, with an additional $120 million in estimated
costs for replacement of vehicles, technology, and systems, over 30 years; and
WHEREAS, on or about July, 2016, the City of Miami Beach entered into a Memorandum
of Understanding (MOU) with Miami-Dade County, The Florida Department of Transportation, and
the City of Miami which, among other things, provided for the County's preliminary development of
a light rail/modern streetcar project that would connect the City of Miami Beach and City of Miami,
with a recommended route from downtown Miami via the Macarthur Causeway, in the vicinity of 5th
Street, and Washington Avenue, directly to the Miami Beach Convention Center (the "Beach
Corridor Project"); and
WHEREAS, the MOU also allowed the City of Miami Beach to proceed with its
environmental review for the Miami Beach Light Rail/Streetcar Project, with the intent of ultimately
aligning the City Project with the County's Beach Corridor Project; and
WHEREAS, during public involvement and outreach meetings, many City residents (either
individually or through resident organizations such as the South of Fifth Neighborhood Association
and Miami Beach United, or advisory boards such as the City's Budget Advisory Committee), have
expressed a clear desire for Miami-Dade County to first confirm that a connection across the
Macarthur Causeway will materialize, before the City undertakes the significant costs and efforts
associated with the City Project; and
WHEREAS, on February 16, 2016, the Miami-Dade Metropolitan Planning Organization
("MPO") unanimously approved a policy to set as "highest priority" the advancement of rapid transit
corridors and transit supportive projects for Miami-Dade County; and
WHEREAS, on April 21, 2016, the MPO officially adopted and endorsed the proposed
Strategic Miami Area Rapid Transit (SMART) Plan for mass transit projects in Miami-Dade County,
to advance six of the rapid transit corridors, along with a network system of Bus Express Rapid
Transit service; and
WHEREAS, the Beach Corridor is one on the six SMART plan rapid transit corridors, and
the Miami-Dade County Mayor and County transit staff have repeatedly voiced commitments to the
Beach Corridor Project; and
WHEREAS, Miami Dade County is preparing a financially feasible plan for all six
corridors of the County's SMART Plan, anticipated to be completed by summer of 2017; and
WHEREAS, the City of Miami Beach desires for the Beach Corridor Project to be a top
priority in the Miami-Dade SMART Plan, in view of the potential for significant Federal funding for
infrastructure projects in the next few years; and
WHEREAS, given the significant cost and effort associated with the City Project, and the
clear desire from residents for better assurances with respect to a rail connection across the
Macarthur Causeway, the Mayor and City Commission believe that the most prudent course of
action is to require, as a threshold matter before any final approval of an Interim Agreement for the
City Project, formal action by the Miami-Dade County Board of County Commissioners with
respect to the Beach Corridor Project and the connection across the Macarthur Causeway; and
WHEREAS, although the City has to date made significant progress in moving forward
the procurement and development of the City Project, deferring action on the City Project and the
proposed Interim Agreement will permit the City to continue to conduct community outreach efforts,
finalize the environmental reviews, and explore all available funding options, including the City's
potential eligibility for federal funding for the City Project, which could include federal funding of up
to 50% of project costs and State funding of up to 25% of project costs; and
WHEREAS, although the County is unlikely to identify a funding plan and take action on
the Beach Corridor Project until late 2017 at the earliest, the City, in partnership with the County,
desires to continue to position the City to move forward expeditiously in the direction of meaningful
traffic solutions for the City's residents and visitors, so that the City may be a ready, willing and
able partner to move forward with the City Project once the County commits to the Beach Corridor
Project and a connection across the Macarthur Causeway.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission
of the City of Miami Beach, Florida, hereby:
(1) support transportation initiatives intended to reduce traffic congestion and reduce
the number of vehicles using the Macarthur Causeway to access Miami Beach, including short-
term initiatives such as Miami-Dade County's ("County ) Bus Express Rapid Transit Se rvice, and
long-term traffic reduction projects, such as the County's development of a light rail/modern
streetcar across the Macarthur Causewa y to link the Cities of Miami Beach and Miami "Beach
Corridor Project");
(2) require formal action by the Miami-Dade County Board of County Commissioners,
confirming that the County has committed to proceed in a binding way, including a funding plan,
with respect to the County's Beach Corridor Project and the connection across the Macarthur
Causeway, prior to City Commission approval of any Interim Agreement for the Miami Beach Light
Rail/Modern Streetcar Project; and
(3) continue to pursue all available funding options, including the City's potential
eligibility for federal funding for the City Project, as well as funding from the State of Florida and
Miami-Dade County; and
(4) require approval of any final Comprehensive Agreement by a majority of the voters
voting in a City-wide referendum.
