A Resolution of the Mayor and City Commission of the City of South Miami, Florida, supporting legislative efforts to repeal, or in the alternative, amend section 403.7033, Florida Statutes, so that local governments are no longer preempted from enacting legislation regulating non-degradable containers. WHEREAS, the City Commission diligently strives to preserve the environment and which is important to the economy of the City of South Miami; and WHEREAS, plastic bags and Styrofoam containers are detrimental because they do not fully degrade and they introduce unsafe chemicals into our environment; and WHEREAS, plastic bags and Styrofoam containers create the potential for the death of land and marine animals through entanglement and/or ingestion; and WHEREAS, the expansive usage of single-use bags and their typical disposal rates creates ap\impediment to the City's waste reduction and recycling goals, while creating unsightly litter; and WHEREAS, single-use plastic bags and containers are difficult to recycle and frequently contaminate material that is processed through the City's recycling programs; and WHEREAS, replacing single use bags and containers with reusable bags and containers is considered a quick and easy way to reduce waste and litter, protect wildlife and conserve resources; and WHEREAS, the City Commission acknowledges that some businesses have taken affirmative steps to accomplish this goal and recognizes their proactive efforts; and WHEREAS, it is in the best interest of the public for the Florida Legislature to allow local regulation of single-use bags and containers. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, AS FOLLOWS: Section 1. The above Recitals are true and correct and incorporated herein by this reference. Section 2. The City Commission of the City of South Miami supports the repeal of,or,in the alternative,an amendment to,Section 403.7033,Florida Statutes, which would allow for local regulation of non-degradable bags and containers,such as those made of plastic and Styrofoam. Page 1 of 2 Res. No. 231-16-14786 Section 3. A copy of this resolution shall be sent to all members of the Florida Legislature and all elected officials throughout Florida Section 4. Severability.If any section clause,sentence,or phrase of this resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction,the holding shall not affect the validity of the remaining portions of this resolution.
