AFTER ACTION
The meeting was called to order at 2:10 p.m.
1. Introductions were made. Welcome remarks.
2. Designation of Chair: per Fla. Stat. Sec. 102.141(1) County Court Judge Cohn is
Chair.
ACTION: Jean Olin, Special Counsel, explained that this is the Canvassing Board
for the November 3, 2015 General Election and for the November 17, 2016 Run-Off
Election, and pursuant to Florida Statute §102.141(1), Hon. Don S. Cohn, County
Court Judge is designated as Chair.
Rafael E. Granado, City Clerk and Ms. Elizabeth Wheaton shall serve as the other
two members of the City's Canvassing Board.
Mr. Granado explained that due to a surgical procedure, he will not be able to attend
the Canvassing Board meetings after October 18, 2015, and requested approval,

consistent with Florida law, for the Chair to appoint one of the Alternate members as
the substitute member to attend all subsequent Canvassing Board meetings as
substitute for City Clerk Granado.
Ms. Olin recommended that of the two Alternative members, Judge Cohn consider
selecting Alternative Board member Jimmy McMillion to serve as substitute for Mr.
Granado, since Mr. McMillion has served as a Canvassing Board member in the
past, and is familiar with the process, and since Alternative Board member Victoria
Ferrer has previously been designated by Chief Judge Bertila Soto to serve as
substitute member in the event that Judge Cohn or Board Member Wheaton are
unable to attend a Canvassing Board meeting. Judge Cohn accepted the
recommendation and appointed Mr. McMillion to serve in such capacity--Jimmy
McMillion will serve as a Canvassing Board member in Mr. Granado's absence.
During Board discussion of Canvassing Board meeting dates, Ms. Wheaton
informed the Board of her inability to attend the scheduled Canvassing Board
meeting on November 20, 2015 (if such meeting is needed due to Runoff Election)
due to her previously scheduled travel plans.
Judge Cohn requested that the Office of the City Clerk notify Judge Ferrer of the
inability of Ms. Wheaton to attend Canvassing Board's meeting on November 20,
2015, and that she serve as the substitute. Office of the City Clerk to handle.
3. Orientation--Sunshine Law, Public Records; also, discussion noting role of
Canvassing Board members re: absentee and provisional ballots, and discussion
regarding role of "Alternative" members.
ACTION: Attorney Olin explained the provisions of the Sunshine Law, Public
Records Law, and general overview of duties of Canvassing Board members in
relation to the City's General and Runoff Elections. The Office of the City Clerk will
notice all Canvassing Board meetings.
4. Review Canvassing Board Schedule.
ACTION: Motion to designate City Clerk Granado as the Canvassing Board member
to attend the Logic and Accuracy test on October 15, 2015 made by Ms. Wheaton,
seconded by Mr. Granado; Voice-vote: 3-0.
ACTION: Consistent with above, motion to designate Alternate Board Member
McMillion to serve as Board Member responsible for attending future Logic and
Accuracy testing.as an Alternate member of the Canvassing Board by Mr. Granado;
seconded by Ms. Wheaton; Voice vote: 3-0.
5. Establish criteria for acceptance of absentee ballots and designate Canvassing
Board member to act on behalf of the Board, if necessary.

Attorney Olin explained discretionary duties of Canvassing Board The act of
canvassing is reserved to the Canvassing Board members, subject to the public's
ability to observe said proceedings.
ACTION: Motion to designate Jimmy McMillion as Canvassing Board member to
attend the November 12, 2015 Logic and Accuracy Test made by Ms. Wheaton;
seconded by Mr. Granado; Voice vote: 3-0.
ACTION: Motion made by Mr. Granado to designate Jimmy McMillion as the
Alternate to attend in Mr. Granado's place from November 3, 2015 through
November 17, 2015 as needed; seconded by Ms. Wheaton. Voice vote: 3-0.
6. Review State Rule IS-2.027 regarding Standards for Determining Voter's Choice on
a ballot. (See Exhibit A)
ACTION: Rule was discussed/reviewed for the General and Run-Off Elections.
7. Open the meeting for public comment.
ACTION: No public comment due to absence of any members of public in
attendance.

Pursuant to Florida Statute §101.5612, notice is hereby given of the time and location of the public preelection test
of the automatic tabulating equipment (Logic and Accuracy Test) for the November 3, 2015 Miami Beach General
and Special Elections.
Pursuant to Florida Statute §102.141, notice is hereby given of the time and place during which the City of Miami
Beach Canvassing Board for the November 3, 2015 Miami Beach General and Special Elections will meet to
canvass the absentee electors' ballots and provisional ballots.
The City of Miami Beach Canvassing Board will convene at the Office of the Supervisor of Elections, 2700 NW 87
Avenue, Miami (Doral), Florida. The Canvassing Board is convening on these dates in preparation to conduct the

1S-2.027 Standards for Determining Voter's Choice on a Ballot.
(1) Application. The standards in this rule apply to determine whether the voter has clearly
indicated a definite choice for purposes of counting a vote cast on a ballot in a manual recount
as provided specifically by Section 102.166 F.S.
(2) Direct recording electronic voting system.
(a) A vote cast on this voting system is valid for a particular candidate, issue choice, or
judicial retention choice when the voter marks the ballot electronically as specified in the ballot
instructions.
(b) A vote cast on this voting system is valid for a particular write-in candidate when the
voter types on the touch screen the name of a write-in candidate in accordance with the ballot
instructions.
(3) Optical scan voting system.
(a) A vote cast on this voting system is valid for a particular candidate, issue choice, or
judicial retention choice when the voter marks the ballot as specified in the ballot instructions.
(b) A vote cast on this voting system is valid for a particular write-in candidate when the
voter writes in the name of a candidate in the designated write-in space and fills in the oval or
arrow next to the write-in candidate's name.
(4) Manual review and tabulation.
(a) The standards under this subsection apply in all instances where a contest is not marked
as specified in the ballot instructions under subsection (2) or (3) and a manual review of the
voter's markings on a ballot is required to determine whether there is a clear indication that the
voter has made a definite choice in a contest.
(b) The canvassing board must first look at the entire ballot for consistency. Then the
provisions of paragraph (c) apply to determine whether the voter has made a definite choice in a
contest, provided the voter has not marked any other contest on the ballot, or if the voter has
marked other contests, he or she has marked them in the same manner, subject to the
exceptions in subparagraphs 7., 10., and 15. The following are examples of valid votes after
review for consistency:
