ALLEY. OR HIGHWAY IN THE CITY OF MIAMI BEACH, FLORIDA, OR TO OBSTRUCT ANY STREET, ALLEY OR HIGHWAY IN SAID CITY WITH BUILDING OR OTHER MATERIAL AND PROVIDING A PENALTY FOR THE VIOLATION OF THISORDINA110E. . . . . . . . . . . . . . . . . . . . . . . . . . . .. . BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF Miami Beach, Florida. 1. It shall be unlawful for any person, firm or corpor- ation to permit any trash, wood, lumber, glass, rock, nails or any such substance to drop from any wagon, truck, wheel- barrow, automobile, or any other vehicle upon any street, alley or highway within the City of Miami Beach, Florida, or to haul any such trash, wood, lumber, glass, rock, nails or any such substance in any vehicle so that the same does drop from such vehicle upon any street, alley or highway in the City of Miami Beach, Florida, or to place any trash, lumber, wood, glass or other substance in any street,alleyor highway or on any side- walk in the City of Miami Beach, Florida, provided, however, that any person or persons actually building or about to build or repair any sewer line, water, or gas mains or piping may collect and lay all such materials as may be necessary for such purposes adjoining the place where such building or repairing is to be done or in front ofsuch building , and shall have the privilege in such cases of using one-third of the width of the street adjoining the front of such building or repairs, but in no event shall any person obstruct the sidewalk in front of or along the site or place where such improvement is being made or where such building is in such process of repair or con- 0 on » Engineer struction except with the written consent of the City Of the City of Miami Beach, Florida. And in no event shall such an obstruction of such sidewalk be permitted for a longer period than two days, and PROVIDED FURTHER that the owner, proprietor, I a • r of such materials, or his agent, shall cause a lamp or lantern with a good and sufficient light therein to be securely hung up, placed or fixed on a post or otherwise at each end of the pile of material which may be lying in any street, alley or highway, and obstructing the same, and the same shall be placed in such manner as to clearly and plainly show the place and extent of the occupancy by such material and such lamp or lantern shall be lighted by the owner, proprietor or employees, at or before dark in the evening and shall be kept burning until daylight* And when building or any part thereof are erected or increased in height to over one story above or along any street or side- walk, the person erecting or altering such building shall erect and maintain an improved substantial shed from lot line to the sidewalk curb for the full frontage of the building and such shed shall have a clearance above the sidewalk of not less than eight feet and shall be open at both ends and on the side next to the street. 2. Any person violating; any of the provisions of this section shall be fined not exceeding One Hundred Dollars or imprisoned in the City Jail not exceeding thirty days, or by both such fine and imprisonment. 3. Each time that any trash, wood, lumber, glass , rock, nails or any such substance shall be dropped or permitted to be dropped upon any street, alley or highway in said City shall be construed as a separate offence against this Ordinance and every day that any obstruction, as aforesaid, shall be main- tained on any street , alley, highway or sidewalk within said City, shall 0 constitute a separate offence against the pro- visions of this Ordinance.
