BE IT ORDAINED BY THE CI'-VY COUNCIL OF TIIL CITY OF MIAMI BEACH FLORIDA: Section 1. That from after the passage of this Urdinance and its publi- cation ubli- cation as required by law, that part of Alton road, situated, lying and being in the City of Miami .beach, in the County of .Dade, and atate of vlOr- ida, and more particulaBy described as follows, to-wit , namely: Beginning at the northwest corner of Block 79, as shown on Plat of ocean Beach addition f3, Flat book 2. Page 81, Public records of Dada County, r'lorida, and running due Viest along the forth line of said Block 79 , produced due West to the 4est line of Alton Road thence in a Southeasterly direction along the West line of said Alton Road to the Southeast corner of Lot 5 of Block 111, as shown on Plat of ocean Beach Addition jr3, in Plat Book 2, rage 81, Pub- lic '?ecords of Dade County, Florida, thence East to the South end of said Block 79; thence in a Northwesterly direction along the .past line of said Alton Road to the point of beginning. Be and the same is hereby closed, vacated and its use to the public d.is- conti.nued and abolished, provided however, that Whereas, the City of Miami Beach has leased to one Ge®rge J. Pilkington, the following described property, situated lying and being in the County of Dade, and State of Florida, and more particularly described as follows, to*wit• Block 79 as shown on the plat of Ocean Beach Addition #3, Plat Book 2, Page 81, Public Records of Dade County., Florida, for a period of two years from the first day of August, A. D. , 1918, with an option to buy the same within the period of said lease, namely two years from the said 1st clay of August , A. D. 9 1918, and by the terms of said lease and option, has agreed to give to the said George J. Pilkington, the use and occupancy of the said street above described, and has agreed further with the said George J. Pilkington to close said part of- said street for the term of said lease, and in the event the said George J. Pilkington shall exercise his option for the purchase of the said Block 79 , as above described, within the time limited in said lease, to make the closing, vacation, discontinuance and abolition of said part of street permanent. NOW, THEREFORE, in the •event S the said George J. Pilkington, under the terms of said lease and option shall fail to exevute his said option within the time specified in said lease, then in such event the said part of said street shall be reopened to the public, and its use and occupation, by the public, as a street be resumed and continued. Section 2. That this Ordinance shall take effect immediately upon its passage, approval and publication as required by law. Section 3. That all Ordinances or parts of Ordinances in conflict with the provisions hereof, be and the same are hereby repealed. PASSED and ADOPTED this 20th day of August, A. D. 9 1918.
