Ordinance 1466 ORDINANCE NO. 1466
AN ORDINANCE PROHIBITING THE ISSUANCE OF BUILDING
PERMITS FOR STRUCTURES WHICH PROVIDE FOR MORE THAN
ONE SINGLE FAMILY HOUSEKEEPING UNIT UNLESS PERMANENT
PARKING SPACES ARE PROVIDED FOR THE USE OF THE
OCCUPANTS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1: No building permit shall be issued by the Building
Inspector of the City of Miami Beach for the erection,
construction, reconstruction or alteration of any structure which
provides for more than one single family housekeeping unit unless
and until there shall be provided, for use by the occupants of such
structure, permanent parking spaces in number equal to three (3)
parking spaces for each two (2) living units provided, however,
that in the event that hotel rooms are being converted or altered
into apartment units conforming to all applicable ordinances and
upon a determination by the City Council that unreasonable hardship
will result if this provision is strictly enforced, and upon a
certification to the Building Inspector of such determination, the
Building Inspector shall issue a building permit notwithstanding
the failure to provide parking spaces as aforesaid.
SECTION 2: The parking spaces required by Section 1 of this
ordinance shall be hard-surfaced and not less than
160 square feet in area each, with clear access thereto, and shall
be located on the same property as the main building, or on property
contiguous thereto and situated conveniently near but not to exceed
a distance of 800 feet therefrom, not including any intervening
streets and alleys.
SECTION 3 : All ordinances or parts of ordinances in conflict
herewith be and the same are hereby repealed.
SECTION 4: The health and welfare of the City being in peril the
three readings of this ordinance shall be had in one
session and the City Council finding that this ordinance is neces-
sary for the immediate protection of its citizens, it shall therefore
go into effect immediately upon its passage.

City of Miami Beach, Florida, has been posted by me in
three conspicuous places in the City of Miami Beach, one
of which was at the door of the City Hall in said City on
the 10th day of October A,D. 19 62 , and that said
Ordinance remained posted for a period of at least thirty
days in accordance with the requirements of the City
Charter of the said City of Miami Beach.
