Ordinance 1469 ORDINANCE NO. 1469
AN ORDINANCE AMENDING ORDINANCE NO. 289,
COMMONLY KNOWN AS THE "ZONING ORDINANCE
OF THE CITY OF MIAMI BEACH, FLORIDA. "
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION to That Section 16-C of Ordinance No. 289, commonly known
as the "Zoning Ordinance of the City of Miami Beach,
Florida" , be and the same is hereby amended by adding, immediately
following that paragraph entitled and pertaining to"Height District
No. 4" , a new paragraph entitled "Height District No. 5" and to
read as follows:
"Height District No. 5
In Height District No. 5 no building shall be
erected, constructed, reconstructed or structurally
altered in excess of eight (8) stories in height or in
excess of ninety (90) feet in height above grade, and
shall in addition be subject to all other limitations
and restrictions applicable to land and buildings,
situate in Height District Numbers 1 through 4, as said
Districts are described, defined and regulated in and
by this Section, and shall comply with all the require-
ments of the Building Code of the City of Miami Beach,
Florida.
Height District No. 5 shall include all parcels
of land in that area of the City of Miami Beach bounded
on the north by the southerly line of Lincoln Road, on
the west by Biscayne Bay, on the south by Government Cut
and on the east by the Atlantic Ocean. "
SECTION 2e All ordinances in conflict herewith be and the same
are hereby repealed.
SECTION 3o The health and welfare of the City being in peril,
the three readings of this ordinance shall be had
in one session and the City Council finding that this ordinance
is necessary for the immediate protection of its citizens it shall
therefore go into effect immediately upon its passage.
