Ordinance 1491 ORDINANCE NO. 1491 AN ORDINANCE A14ENDING ORDINANCE NO. 789, BEING AN ORDINANCE OF THE CITY OF MIAMI BEACH, FLORIDA, ESTABLISHING OFFICIAL CLASSIFICATIONS OF POSITIONS IN THE CLASSIFIED SERVICE OF THE CITY OF MIAMI BEACH, FLORIDA, AND PROVIDING COMPENSATION THEREFOR, PURSUANT TO THE PROVISIONS OF THE CIVIL SERVICE ACT; AND PRO- VIDING FOR THE ADMINISTRATION OF THIS ORDINANCE AND REPEALING ORDINANCES IN CONFLICT HEREWITH. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,FLORIDA: i SECTION 1: That Section 1 of Ordinance No. 789, being an ordinance of the City of Miami Beach, Florida, establishing official classifications of positions in the classified service of the City of Miami Beach, Florida, and providing compensation therefor, pursuant to the provisions of the Civil Service Act; and providing for the administration of this ordinance and repealing ordinances in conflict herewith, be and the same is hereby amended to read as follows: "Section 1. The following titles shall constitute the Classifi- cation Plan, and the titles together with the prescribed pay schedules shall constitute the Compensation Plan, both as provided for in the Civil Service Act and the Personnel Rules, for the Classified Service of the City of Miami Beach, Florida. Compensation in the Classified Service after September30, 1963 shall not be less than the prescribed minimums nor more than the prescribed maximums, except as otherwise provided herein. 1. Any employee who, on September 30, 1963, was entitled to a greater maximum rate of pay than provided by this ordinance, shall retain entitlement to such maximum rate of pay. " SECTION 3 .- That Section 1.2 of Ordinance No. 789 be and the same is hereby deleted. SECTION 4 : That Section 5 of Ordinance No. 789 be and the same is hereby amended to read as follows "Section_ 5_. The City Manager, upon recommendation of the Department Head and the Director of Personnel, may authorize compensation not more than twenty per cent (20%) in excess of the maximums prescribed in Secl:i(�n I of this ordinance for those employees whose duties and responsibilities are clearly above and beyond the normal scope of positions within their job class; and the City Manager may, upon the recommendation of the Department Head and the Director of Personnel, authorize compensation in excess of the maximums prescribed in Section 1 of this ordinance for those employees who are required to worm sub- stantially beyond the normal work hours of their positions . " 'ECTiON 5 : That Section 62 and Section 8 o% Ordinance No. 789 be and the same are hereby deleted. .SECTION 6 : That Ordinance No. 789 be and the same is hereby amended by adding a new section thereto immediately following Section 7 thereof and to be numbered and to read as follows : "Section 8. The City Idanager, upon recommendation of the Department Head and the Director of Personnel, may authorize compensation of not more than twenty-five per cent (25%) .n excess of the maximums prescribed by Section 1 of this ordinance for those employees whose duties involve exposure to hazardous conditions not normally experienced by other employees of the same job class, except that employees assigned to under water con- struction and maintenance duties shall receive an additional allowance of two dollars ($2 .00) per hour during such assignment. " SECTION 7 : That Ordinance i\To. 789 be and the same is hereby amended by adding the following sections to be n,ambered and to -ead as follows : "Section 9 . That all ordinances or parts of ordinances in conflict herewith are hereby repealed. " "Section 10. If any portion of this ordinance shall be declared invalid, the remaining portions shall have the same force and effect as though such invalid portion or portions had not been included.
