Ordinance 1513 ORDINANCE NO. 1513 AN ORDINANCE AMENDING CHAPTER 35 OF "THE CODE OF THE CITY OF MIAMI BEACH, FLORIDA, 1950", AS AMENDED. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1: That that portion of Section 35.39.1 of "The Code of the City of Miami Beach, Florida, 1950", as amended, reading as follows: "SECTION 35.39.1. The Chief of Police, with the approval of the City Manager, shall designate certain locations on public streets or other public places in the City of Miami Beach as taxi stands in a num- ber sufficient to allow at least one parking place for each taxicab licensed to operate within the City of Miami Beach. The Chief of Police shall designate the number of vehicles which shall be allowed to stand in each taxi stand so designated and shall mark by appro- priate signs the location of each taxi stand so designated and the number of vehicles allowed to be parked therein. only taxicabs in such numbers as are set forth on the taxi stand signs may remain at the stand while waiting for employment, and only in single file pointed in accordance with the traffic regulations. No taxicab standing at the head of any such line shall refuse to carry any orderly person applying for a taxicab who agrees to pay the proper fare, but this shall not prevent a passenger from boarding the taxicab of his choice that is parked at a taxi stand, and as the taxi- cabs leave the line with passengers, those behind shall move up, and any taxicab seeking a space on the stand shall approach same only from the rear of the stand and shall stop as near as possible to the last cab already in the line. No taxicab standing in the line except the taxicab standing at the head thereof shall leave the taxi stand for the purpose of answering any call except as hereinbefore permitted. " be and the same is hereby amended to read as follows: "SECTION 35.39.1. No taxicab other than the taxicab standing at the head of any such line shall respond to a call from a hotel or apartment house, prov:Lded, however, that nothing herein contained shall be deemed to prohibit any taxicab, regardless of its position in such taxi stand, from leaving the same for the purpose of :serving any point within the City which is more than 399 feet distant from said taxi stand, but further provided that no taxicab shall park on the premises of any hotel or apartment house, or other private property while waiting for employment and for the purpose of obtaining patronage ahead of taxicabs standing in taxicab stands. " SECTION 2: All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 3: This ordinance shall go into effect immediately upon its passage and posting as required by law. PASSED and ADOPTED this 17th day of June , 1964.
