Ordinance 1526 ORDINANCE NO. 1526
AN ORDINANCE AMENDING ORDINANCE NO. 289,
COMMONLY KNOWN AS THE "ZONING ORDINANCE
OF THE CITY OF MIAMI BEACH, FLORIDA" .
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1: That Paragraph 3 of Section 6 of Ordinance No. 289,
the same being the "Zoning Ordinance of the City of
Miami Beach, Florida", be and the same is hereby amended to read .
as follows:
113. Restaurants in which the roofed-in
floor area of the room or portion
of the building wherein food is
served to guests is not less than
400 square feet with not less than
75 per cent of the total of such
roofed-in floor area being utilized
for the seating of guests at tables
or booths. The ratio of the number
of seats at tables and booths to
the number of seats at counters
shall be not less than three to one,
and the total number of seats shall
not exceed the ratio of ten (10)
square feet of such roofed-in area
to one guest. Toilet facilities
shall be so arranged as to provide
the public direct accessibility
thereto from within such roofed-in
floor area, provided, however, that
the foregoing requirements shall
not be applicable if the preparation
and serving of food or beverages is
a customary incident to the uses or
businesses permitted in or by this
Section. "
SECTION 2: All ordinances in conflict herewith be and the same
are hereby repealed.
SECTION 3: This ordinance shall go into effect immediately
upon its passage and posting as required by law.

having been passed and adopted by the City Council of the
City of Miami Beach, Florida, has been posted by me in
three conspicuous places in the City of Miami Beach, one
of which was at the door of the City Hall in said City on
the 8th day of October A,D. 19 64 , and that said
Ordinance remained posted for a period of at least thirty
days in accordance with the requirements of the City
Charter of the said City of Miami Beach.
