ORDINANCE NO. 1531
AN ORDINANCE AMENDING SECTION 5.09 OF ORDINANCE NO. 845
OF THE CITY OF MIAMI BEACH, FLORIDA, ENTITLEI3�.` "AN ORDINANCE
PROVIDING FOR THE CREATION AND MAINTENANCE OF A PENSION
AND RETIREMENT SYSTEM FOR CERTAIN EMPLOYEES OF T� CITY
OF MIAMI BEACH, FLORIDA
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA:
SECTION l. That Section 5.09 of Ordinance No. 845 of the City of
Miami Beach, Florida, reading as follows:
"Section 5.09 No �mployee Member who has met the requirements
for Service Retirement as specified in Sub-section
5.03.01, and no Employee Member who has to his credit the required
number of years of Creditable Service and is within five (5) years
of the specified retirement age for that number of years of Cred.it-
able Service as prescribed in Sub-section 5.03.01, shall forfeit
his right to such Retirement by reason of subsequent separation
from his employment with the City by lawful removal for cause;
provided. that no Retirement Allowance shall be commenced under
this Section prior to the age at which su�h removed Employee
Member would otherwise be eligible to receive benefits."
be and the same is hereby amend.ed to read as follows:

entitled to a deferred Retirement Allowance.
No Employee Member who has met the requirements for Service
Retirement, as specified. in Sub-Section 5.03.01, and no
Employee Member who has to his credit the required number of
years of Creditable Service and is within five (5) years of the
specified retirement age for that number of years of Cred,itable
Service, as prescribed in Sub-section 5.03.01, shall forfeit
his right to such Retirement by reason of subsequent separation
from his employment with the City by lawful removal for cause;
provided that no Retirement Allowance shall be commenced under
this Section prior to the age at which such removed. Employee
Member w�ould otherwise be e�g��:�le to receive benefits. "
SECTION 2. That all ordinances or parts of ordinances in conflict
herewith be and the same are hereby repealed..
SECTION 3. That this ordinance shall go into effect immediately
upon its passage and posting as required by law.
