ORDINANCE NO. 1551
Al� OI�DINANC� AI�NDING ARTICLE II, CHAPTER 2,
OF` THE �OD� OF THE C I Z'�' OF MIAMI BEACH ,
FLORIDA.
BE IT OI�DAINED BY THE CIT�' COUNCIL E3F TS� CITY �F �+SIAMI BEACH,
FLO�IDA:
S�CfiIaN l: That Se�tion 2-33 of the Code of the City of l�iami
Beach be and the same is hereby amended to read a�
follows: -
"Sec. 2-33. To qualify with city clerk, time.
Candidates for the office of city councilman
or mayor shall qualify with the city clerk not
more than forty-five days nor l�ss than thirty
days prior to the election for the office of
city councilman or mayor."
SE�TION 2: T�hat Section 2-34 of the Code of the City of Miami
Bea�h be and the same is hereby amended to read as
followss
"gec. 2-34. Fee; photographing and finger-
printing; oath.
Candidates for the offi�e of city councilman
or mayor shall qualify by paying to the city
clerk a fee of ane hundred fifty dollars as a
qualifying fee, by being photographed and
fingerprinted by the identification bureau of
the city poli�e departFaent, and by signing
the oath required b�r this artiele."
SE�T24N 3: T�hat Section 2-35 of the �ode of the City of Miami
Beach be and the same is hereby amended to r�ad as
follows:
"Sec. 2-35. Candidates to be qualified electors
of city.
Gandidates �or the office of city councilman
or mayor shall be qualified electors of the
city "
� SECTIQAT 4; T�hat Section 2-36 of the �ode of the �ity of Miami
' Beach be and the same is hereby amend�d to read as
follovvs :
"Sec. 2-36. �ontents, filing and form of
oath.
Ever�y candidate for the office of �ity
Councilman or mayor shall take, sign and
subscribe to an oath or affirmation in

writing in which he will state,
(a) Tfhe title of the office for which
he is a candidate.
(b} Trhat he is a qualified �lector of
the city.
(c) His legal residence by street and
number.
(d) W'hether or not he has ever been con-
victed of a felony.
(e) That he is qualified under this Code,
the ordinances and Charter of the eity to
hold the office for which he is a candidate.
(f) That he has paid the qualifying fee
required by section 2-34.
(g) Z'''hat he has not violated any of the
ordinanc�s or laws of the city or of the
state relating to the election or registra--
tion of e�lectors.
(h) 'I�hat he is not a me�nber of nor does
he subscribe to the principles of any group
that seeks to overthrow the government or
the Constitution of the United States of
Amer�ca.
Such oath or affirmation shall be filed �
with the city elerk simulta�:eously with the
payment of the required qualifying fee .

T�hat section 2-38 of the �ode of th� City of Miami
Beach be and the same is hereby amended to read as
"Sec. 2-38. Names of qualified candidates to
be printed on ballot.
All persons who have paid the qualif�ing
fee, signed the oath or affirmation, and who
shall have beeari photographed and finger-
printed, as provided in this article, shall
be qualified candidates for the office of
city councilman or mayor, as the case may be,
at the next election, and the city cl.erk
sha11 print their names on the ballot in
alphabetical order."
All ordinances in confliet herewith be and the same
are hereby repealed.
7'his ordinance shall go into effect irmnediately upon
its passage and posting as required by law.
