AN ORDINANCE AMENDING ORDINANCE NO. 845 OF THE CITY
OF MIAMI BEACH� FLORIDA� ENTITLED "AN ORDINANCE PROVID-
ING FOR THE CREATION AND MAINTENANCE OF A PENSION AND
RETIREMENT SYSTEM FOR CERTAIN EMPLOYEES OF THE CITY OF
MIAMI BEACHa FLORIDA
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH? FLORIDA:
SECTION l. That Section 4.13 of Ordinance No. 845 of the City of
Miami Beach� Florida� reading as follows:
"4.13 Any Member of the Retirement System created. by this
Ordinance who is granted a Military Leave of Absence from service
with the City for active duty as a member of the Armed Forces of the
United States shall have the privilege of continuing his Employee °
Normal Contributions during the period covered by such leave� at the
rate and on the salary basis which determined the amount of Employee
Normal Contributions at the time such Military Leave was granted�► or
such Member� upon his return to his City duties maya within three (3)
years� thereafter,� make a lump sum contrib�.tion equivalent to his
accumulated Employee Normal Contributions for the period of Military
Leave and interest thereon at three (3j percent compounded annually.
Notwithstanding the definition of "Creditable Service"� or any other
provisions of this Ordinance to the contrary,� any period of Military
I�eave for which a Member contributes,� as provided above� shall be
deemed Greditable Service."

governmental agency or authority because of tuberculosisa cholera�
plaguea louse borne typhus or relapsing fever shall have the
privilege of continuing his Employee Normal Contributions during
the period covered by such leave or by such quarantine� isolation
or confinement at the rate and on the salary basis which determined
the amount of Employee Normal Contributions at the time such military
leave was granted or such quarantine� isolation or confinement began�
or such Member� upon his return to his City duties may,� within three
(3} years thereafter,� make a lump sum contribution equivalent to his
accu�ulated Employee Normal Contributions for the period of Military
Leave� or of quarantine� isolation or confinement1 and interest
thereon at three (3/) percent compounded annually. Notwithstand.ing
the definition of "Creda.table Service" or any other provisions of
this ordinance to the�'`� ontrary� any period of military leavea or of
quarantine� isolatio or confinement� for which a Member contributes
as herein provided� shall be deemed Creditable Service."
SECTION 2. That all ordinances or parts of ordinances in conflict here-
with be and the same hereby are repealed.

SECTION 3. That this ordinance shall go into effect immediately
upon its passage and posting as required by law.
