Ordinance 1595�. � '� �� � Y •• w ' ORDINANCE NO. 1595 � � . ,.. + r _ AN ORDINANCE AMENDING ORDINANCE NO. 845 OF THE CITY OF MIAMI BEACH, FLORIDA, ENTITLED "AN ORDINANCE PROVIDING FOR THE CREATION AND MAINTENANCE OF A, PENSION AND RETIREMENT SYSTEM FOR CERTAIN EM- PLOYEES OF THE CITY OF MIAMI BEACH, FLORIDA". BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION l: That Section 2.27 of Ordinance No. 845 of the City of Miami Beach, Florida reading as follows: "2.27 Service (Creditable): The Length of Ser- vice prior to age seventy (70) or prior to the date on which re- tirement or other benefits become due as the re- sult of application for such as herein provided, excluding all periods prior to the date upon which a member, having received a Separation Refund or having joined the Police and Fire Pen- sion Plan, again becomes a Member." is hereby amended to read as follows: "2.27 Service {Creditable): The Length of Ser- vice prior to age seventy (70) or prior to the date on which re- tirement or other benefits become due as the re- sult of application for such as herein provided, excluding all periods prior to the date upon which a member, having received a Separation Refund or having joined the Police and Fire Pen- sion Plan, again becomes a Member; provided, however, that notwithstanding anything to the contrary in this ordinance the creditable ser- vice of persons who were, on or after January 1, 1966, Employee Members of the System, shall in- clude all periods of time of actual work for which wages or salaries were received by them from the City, including all time served in the unclassified service of the City, and including any and all provisional, probationary or regu- lar work or employment, whether or not such periods of employment were continuous or inter- rupted, together with military service for which employee contributions were made, provided, further, however, that if such creditable ser- vice has not heretofore been credited to such employee member, he shall be entitled to such creditable service upon application made there- for on or before January 1, 1967 and upon the payment of his required 6/ employee contribu- tions upon his theretofore uncredited service, - 1 - OFFICE OF CITY ATTORNEY - 1130 WASHINGTON AVENUE - MIAMI BEACH, FLORIDA 33139 0 � � , ' , " _ ` . • together with compound interest of 3/ upon such required employee contributions, such payment to be made on or before January l, 1970. De- pendent beneficiaries of deceased persons who were employee members specified in this provi- sion shall be entitled to apply for the same credit provided for by this proviso to which the employee member would have been entitled upon the same terms and conditions as herein set forth, and further provided that additional benefits thereby accruing to them shall commence only upon the payment of the employee contribu- tions and interest thereon as herein required." SECTION 2: That Section 4.02 of Ordinance No. 845 of the City of Miami Beach, Florida, be and the same is hereby amended by adding thereto, immediately at the end thereof, a sub- section to be numbered and to read as follows: "4.02.01 Effective January l, 1967, no Addi- tional Contributions shall be accepted by the City of Miami Beach Employees' Retirement System, and those Employee Members having Accu- mulated Additional Contributions on that date shall be required to withdraw such Accumulated Additional Contributions on or before January 1, 1972; any Accumulated Additional Contributions not withdrawn by January l, 1972 shall be refunded directly to the Employee Member for whose account such fund has accumulated." SECTION 3: That all ordinances or parts of ordinances in con- flict herewith be and the same are hereby repealed. SECTION 4: That this ordinance shall go into effect immediately upon its passage and posting as required by law.
