AI+T ORDINAi3CE AUTH4RIZ�NG AND
Ei�iP�%�ERING THE CITY COUNCIL TO
SUSPEI�D OR RENiOVE B�ARD MEMBERS .
BE IT t'�RDAII+�EED BY THE � ITY COUNC IL OF THE C ITY OF MIAMI BEACH,
FLORIDA :
SECTION l. Any Member of any Board of the City of Miami
Beach who has been indicted or informed against
in any Criminal Court of the State of Florida or in a Court
of any other State of the United States or in any Federal
Court, may . Ue fozthwith suspendec� by a majority of the
City Cou�cil. Such suspension �aY . continue un ti l the
acquittal or conviction of such Board Nlember. If the
indictment or in€ormation against such Board Member is
quashed and tne charges dropped by the prosecuting authority,
such action s�all be deemed acquittai hereunder. Tf a
€inding of quilt is entered against such Soard Member, and
adjudi�ation is withheld unde� the provisions of Chapter
948, Florida Statutes, such finding shall be deemed a
conviction hereunder. Acquittal may entit�e such 8oard
�gember to �einstatem�nt far ihe remainirig portion of his
term, but conviction of such Board Member T�ay constitute
farfeiture of his of f ice forthwith, and his of f icF inay
be deem�d vacant. The office of any Board Member susp►enaed
under the provisions hereof shall be deemed vacant for the
period of such suspension, and the City Cauncil is authorized
and empowered to fill such vacancy during the period of
such suspension.
SECTION 2. The City Council, by majority vote. may remove
any Member of any Board created by ordinance or
resolution at any time for cause. If it shall appear to the
City Council that gooc� and sufficient cause exists for such
removal, the City Council shall instruct the City Attorney
to prepare a written charge against the said Board Member.
Such charge shall state specifically the facts alleged to
constitute the cause for remvval. A copy of said written
charge siiall be served personally ugon the Board P�iember
against who� such charge is fi�.ed, or shall be mailed to his
residence by certif ied or registered mail, together with a
notice oi the time aMd place set for a public hearing on
said charge. No such hearing shall be held less than ten (l0)
days after the serving or mailing of the charge and n.otice.
The 8oard Member sha�.]. �iave the right ta appear and be heard
in person or by counsel. Evidence may be heard upon any facts
or circumstances pertinent oz applicable to the charge. After
the completion of the public hearing, the City Council shall
determine �.he truth or untruth of the charge. If a majority
of the City Council finds that the charge has been proven,
tbe said Board P�ember may �hereupon be remo�ed by a majorit�
vote, anc? his office shall �e deemed vacant, and the vacancy
so created shall be filled by the City Council in the same
manner as other vacancie� on the said Board are filled.

SECTION 3. That all ordinances or parts of ordinances
in conf lict herewith be and the same are
hereby repealed.
SECTION �. That this ordinance shall go into effect
immediately ugon its passage and posting as
required by law.
