Ordinance 1640, r � �RDINANCE NO. l� AN �RDINANCE AMENDING ORDINANCE NO. 845 OF THE CITY OF MIAMI BEACH, FL4RIDA, ENTITLED "AN ORDINANCE PROVIDII�TG FOR THE CREATION AND MAINTENANCE OF A PENSI�N AND RETIREMENT SYSTEM FOR CERTAIN EMPLOYEES OF THE CIT'Y OF MIAMI BEACH, FLORIDA". BE IT ORDAINED BY THE CITY COUNCIL OF THE CIT'Y OF MIAMI BEACH, FLORIDA: SECTION l: That Section 2.2� of Ordinance No. 845 of the City of Miami Beach, Florida, reading as follows: "2.27 Service (Creditable� The Length of Service prior to age seventy (70) or prior to the date on which retirement or other benefits become due as the result of application for such as herein provided, excluding all periods prior to the date upon which a member, having received a Separation Refund or having joined the Police and �'ire Pension Plan, again becomes a Member; provided, however, that notwithstand- a,ng anything to the contrary in this ordinance, the Creditable Service of persons who were, on or after January 1, 1966, Employee Members of the System, shall include all periods of time of actual work for which wages or salaries were received by them fxom th� City, including all time se�ved in the unclassified service of the City, and including any and all provisional, proba-- tionary or regular work or emplayment, wnether or nvt such periods of employment were continuous or interrupted, together wi�h military service for which employee con- tributions were made, provided, further, however, that if such credit�ble service has not heretofore been credited to such employee member, he shall be entit2ed to s�:ch creditable service upon application made there�- for on or before Jan*iary 1, 1967, and upon the payment of his required 6;o employee contributions upon his theretofore uncredited service, together with compound intereQt at 39b upon such required employee contributions, such payment to be made on or before January l, 1970. Dependent Beneficiaries of �eceased persons who were em- ployee members specified in this provision shall be en- titled to apply for the same credit provided for by this proviso to which the employee member would have been entitled upon the same terms and conditio�xs as herein set forth, and further provided that a+dditional benefits thereby accruing to them shal.l cornmence only upan the payment of the employee contributions and interest thereon as herein required." �Creditable) Length of ge seventy prior to the date on which retirement or other bene� fits become due as the resuZt of application for such, as her�in provided, excluding all periods prior to the date upon which a Member, having received a 5epa- ration Refund or having jained the Palice and Fire- men's Pension Plan, again becomes a Member. �ECTi�N 2: That �rdinance No. 845 be and the same is hereby amended by adding thereto three new subsections, immediately fol�owing Section 2.27, to be numbered and to read as followss "2.27.01 Notwiths�anding anything to the contrary in this ordinance, the Creditable Service of persons who were, on or afte� January 1, 1966, Employee Members of the System, shal l include a 11. periods of time of actual work for which wages or salaries were received by them from the City, including all time served in the Unclassif ied Service o€ the City, and including any and all provisional, probationary or regular work or employment, whether or not such per- iods of ernployment were continuous or interrupted, together with time served in the militar� service for which Employee Contributions were made; provided, further, however, that if such Creditable Service has not here�cofore been credi�ed to such Employee Member, he shall be entitled to such Creditable Service upon app lication made therefor on or before January 1, 1967, and upon the payment of his required six per cent (6�0} Employee Normal Contributions upon his theretofore uncredited service, together with cort- pound interest of three per cent (3%) upon such re- quired Employee Normal Contributions, such payment to be made on or before January l, 1970. 2.27.02 Natwithstanding anything to the contrary in this ordinance, the Creditable Service of persons whu become E�nplo�ee Members of the System on or af�er January 1, 1967, shall include all periods of time of actual work f�r which wages or salaries were received by ihem trom the City includin+g a11 time served in the Unclassif ied Service of the City, and including any and all provisional, probationary, or r�gular work or employment, whether or not such periods of eniployment were continuous or interrupted, together with time spent in the military service for which Employee Contributions were made; provided, however, that as to persons who beco� Employee Mem- bers of the System after January 1, 1967, Creditable Service shall not include provisional employment where the provisional employee does not immediately thereafter become an Employee Member of the System; provided, further, that creditable service shall also include periods of con�ractual emplayment where the board determines that said contractuai employment was for more than thirty-five (35j hours per consecutive - 2 - � i--�,�, ,..��.�. �, � . r . . � • _ . week, that during the contractual period the employee devoted his full time in the performance of his con- tractual duties, and that the contractual emp],oyment was immediately followed by appointment to the class- if ied or unclassitied service; and provided, further, that such Creditable Service shall be credi.ted to such Employee Member upon application therefor within one year of the time aaid Ernployee Member becomes a member of the System, �nd upon payment of the required 696 Emp loyee Normal Contributions upon his theretofore uncredited service, together with compound interest at the rate of three per cent �3/) upon such required Employee Normal. Contributions, such payment to be made within one year of the time said Employee Mem�er becomes a Member of the System. 2.27.03 Dependent Benefi�iaries of deceased persons who were Employee Members, as specified in subsections 2.27.01 and 2.27.02 hereof, shall be en- titled to apply for the same credit provided for by said subsections 2.27.01 and 2.27.02, to which the Employee Member would have been entitled upon the same terms and conditions, as herein set forth, and further provided that additional benefits thereby accruing to them shall commence only upon the payment of the Employee Contributions and interest thereon as herein required." SECTI4N 3: SECTION 4: That all ordinances or parts of ordinances in con- flict herewith be and the same are hpreby repealed.
