OR.DINANCE NO . 16 5 2-1 AN ORDINANCE AMENDING ORDINANCE N0. 1582 OF THE CITY OF MIAMI BEP,CH, FLORIDA, ENTITLED "MINIMUM HOUSING STANDARDS QRDINANCE ". ! , • . . � , . BE IT ORDAINED BY THE CITY COUNC IL OF THE C ITY OF riIAMI BEACH, FLORIDA: SECTION 1. That paragraph 2 of Section 1.�6 of Ordinance No. 1582 be and the same is hereby amended to read as follows: . "2. BASEMENT: A portion of a building located partly underground, but having }.ess than half its clear fioor-to-ceiling height below the average grade of the adjoining ground." SECTI4N 2. That paragraph 9 of Secti.on 3.06 of Ordinance No. 1582 be and the same is hereby de leted . SECTION 3. That paragraph 20 of Section 1.06 of Ordinance No. 1582 be and the same is hereby amended to read as follows: ` "2U ROOMING HOUSE: Any dwelling, or that part of any dweliing, con- �aining one or more rooming units in which space is let by the owner or operator to three or more persons who are not husband and wife, son or daughter, mother or father, sister or brother of the owner or operator." SECTION 4. That paragraph 21 of SecCion 1.06 of �rdinance No. 1582 be and the same is hereby amended to read as follows: "21 DWELLING UNIT: Any room or group of rooms located within a dwelling and forming a single habitable unit with facilities which are used, or intended to be used, for living, sleeping, cooking and eating." SECTIOIV S. That Section 1.07 of Ordinance No. 1582 be and the same is hereby amended by deieting therefrom the words "Chief Building Inspector" wherever the same is used in said section, and substituting therefor the words "the Directar of the Planning and Zoning Department." SECTION 6. That Section I.09 of Ordinance No. Z582 be and the same is hereby amended by deleting therefrom the words "Chief Building Inspector" and substituting therefor the words "the Director of the Planning and Zoning Department". SECTION 7. That Section 1.10 of Ordinance No. 158� be and the same is hereby amer�ded by deleting therefrom the words "Chief Building Inspector" and substituting therefor the words "the Director of the Planning and Zoning Department", SECTION 8. That Section 1.11 of Ordinance No. i582 be and the same is hereby amended by dele�ing therefrom the words "Chief Building Inspector" and substituting therefor the words "the Director of the Pianning and Zoning Department". SECTION 9. That paragraph 9 of Section 2.01 of Ordinance No. 1582 be and the same i s he reby de le ted . SECTION 10, That paragraph 1 ot Section 2.02 of Ordinance No. 1582 be and the same is hereby amended to read as follows: "1. Every habitable room shall have at least one (1) window or sky- light facing directly to the outdoors, The minimum total window area which provides light to each habitable room sha11 be not 2ess than ten (10°l0) per cent of the floor area of such room. "directly to the outdoors and shall not be included in the ��quired minimum total window area. Whenever the only windvw in a room is a skylight type window located in the top of such room, the minimum total window area of such skylight shall be not less than fifteen (15%) per cent of Che total floor area of Che roam." SECTION 11. That paragraph 2 of Section 2.04 of Ordinance Nv. 1582 be and the same is hereby amended to read as follows: "2. In every dwelling unit of two or more rooms, every room occupied for sleepi.ng purposes by one occupant shall contain at least seventy (70) square feet of floor space, and every room occupied for sle�ping purposes by more than one occupant shall contain at least fif�y (50) square feet of floor space for each occupant thereof ." SECTION 12. Tha t paragraph 3 of Section 2.07 of Ordinance No. 1582 be and the same is hereby amended to read as follows: "3. At least one flush water closet, lavatory basin, and ba�htub or shower, properly connected to a water and sewer system approved by the Dade County Health Officer a�.d in good working condition, shall be supplied for each eight persons or �raction thereof residing within a rooming house, including members of the operator's family whenever they shaxe the use of the said facilities; provided, however, that in a rooming house where roo�ns are let only to males, flush urinals may be substituted for not more than one- half the required number of water closets. All such facilities sha 11 be so located w3,thin the dwe iling as to be reasonably accessible from a cornmon haI]. or passageway to all persons sharing such facilities. Every lavatory basin and bathtub or shower shall be supplied with water at alI times. No such facilities shal.i be located in a basement, except by written approval of the Dade County Iiealth Officer." SECTION 13; SECTION 14. That alI ordinances or parts of ordinances in conf lict herewith be and the same are hereby repealed.
