BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA :
SECTION 1. That Section 18-34 of "The Code of the City of
Miami Beach, Flori�la`' be an�l the same is hereby
amen�led to read as follows:
"Sec. 18-34 Sales near churches and schools.
(a) Liquor. No liquor shall be sold within three
hun�dre�1 (300') feet in an air line from any
church property, nor within three hundred (300)
feet in an air line from any public school
property, nor within three hun�dred (300' ) feet
in an air line from any property upon which there
is maintaine�. a private school operated for the
instruction of minors in the common branches of
learning, except such places of business as are
already establishe�l.
(b) No beer or wine shall be sol�., except in bona
ficle restaurant establishments serving meals
as their principal business, within three hundred
(300') feet from any church property, nor within
three hundred (300') feet from any public school
property, nor within three hun�lred (300' ) feet
from any property upon which there is maintained
a private school operated for the instruction of
minors in the common branches of learning, except
such places of business as are alrea�ly establishe�l;
provi�e�l, that nothing in this subsection shall
apply to or affect the sale of beer or wine where
such beverages are sold only in sealed containers
for consumption off the premises. Distances under
this subsection shall be measured by following the
shortest route of ordinary pe�lestrian travel along
the public thoroughfare from the main entrance of
said place of business to the nearest point of a
church property, and in the case of a school to
the nearest point of the school grounds in use as
part of the school facilities.
(c) No beer or wine shall be sold in bona fide restaurant
establishments serving meals as their principal bus-
iness within two hundred eighty-five (285') feet
from any property used for public worship purposes,
nor within two hundre�l eighty-five (285') feet from
any public school property, nor within two hun�lre�1
eighty-five (285') feet from any property upon
which there is maintaine�l a private school operated
for the instruction of minors in the common branches
of learning, except such places of business as are
alrea�ly establishe�; provi�.e�1, that nothing in this
subsection shall apply to or affect the sale of beer
or wine where such beverages are sold only

places in the City of Miami Beach, one of which was at the door
of the City Hall in said City on the 22n� day of August,1967
and that said Ordinance remained posted for a period of at least
thirty days in accordance with the requirements of the City Charter
of the said City of Miami Beach.
