AN ORDINANCE AMENDING ORDINP�NCE NO. 289
COMNiONLY KNOWN AS THE "ZUNING ORDINANCE
OF Ti3E CITY OF MIAMI BEACH, FLORIDA".
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI
BEACH, FZORIL�A:
SECTION 1: That paraqraph c of Section 17 of Ordinance
No. 289 commonly kncywn as the "Zoning Ordi-
nance of the City of Miami Beach, Florida+= be and the
same is hereby amended to read as follr�vs:
"c. Boat slips, docks, wharves, dolphin
poles, mooring piles or struetures
of any kind shall not be constructed or
erected which extend into any canal or
waterway in the City of Miami Beach more
than ten per cent (lOq) of the width of
such canal or waterway at a specific lo-
cation measured from the sea wall or
property as shown by recorded plat line
if no sea wall exists; but if a canal or
waterway is more than 104 feet in width
the structure may extend into such canal
or waterway a distance not greater than
fifteen per cent (15/0� of the width of
such canal or waterway at that specific
location, but not to exceed a distance
greater than 40 feet; provided, however,
with special permission and recommendation
of the Marine Inspection Board, and appro-
val by the City Council, any dock, wharf,
dolphin, mooring pile or other structure
may extend from a lot zoned for multiple-
family use, into any part of Biscayne Bay
or other waterway, which is in excess of
1,000 fee� in width, a distance not
greater than 125 feet and may extend
from a lot Zoned for business use in�o
Biscayne 8ay or other waterway a distance
not greater than 250 feet. It is fur-
ther provided that any boat, ship or
vessel of any kind shall not be docked
or moored so that its projection into
the waterway would ]�e beyond the permis-
sible projections for such docks, wharves,
dolphin poles, mooring piles or other
structure.
Permits for erection of any of the
above facilities must be obtained from
the Building Inspection Division, the
State Internal Improvement Fund if nec-
essary, and if abutting navigable
streams, the approval of the Corps of

It is further provided that the pro-
visions of Section 14 pertaining to non-
conforming uses shall not be applicable
to this paragraph, and t�at all docks,
wharves, dolphin poles, mooring piles
which presently extend into any water-
ways a distance greater than the per--
missible projections noted herein shall
be removed and made to conform to this
ordinance no later than December 1, 1972.
It is further provided that all
structures described herein which have
be�ome derelict or in disrepair by rea-
� son of disintegration to the extent of
more than 5096 of original dimensions of
�� its constituent memhers shall be re-
placed, removed or reconstructed no
later than November l, 1968 . I f such
_deterioration results in the structure
being below the surface of the water at
mean high tide removal or reconstruction
shall be done no later than March l,
1968. Provided however that this provi-
sion shall not apply to that portion of
Pelican Island lying South of the Julia
Tuttle Causeway and North of the Vene-
tian Causeway. Future structures shall
at all times be maintained in good
repair.

It is further provided that any
structures authorized hereby extending
into waterways or bay 125 feet or more
shall have electrical liqhts at the ex-
tremity thereof. All other structures
hereby authorized shall have affixed
thereto ref lector signals visible from
all approaches and shall be not less
than three (3") inches in their smallest
dimension.
SECTION 2: That all ordinances or parts of ordinances in con-
flict herewith be and the same are hereby repealed.
SECTION 3: That this ordinance shall go into effect immediately
upon its passage and posting as required by law.

having been passed and adopted by the City Council of the City of
Miami Beach, Florida, has been posted by me in three conspicuous
places in the City of Miami Beach, one of which was at the door
of the City Hall in said City on the 16th day of November, 1967
and that said Ordinance remained posted for a period of at least
thirty days in accordance with the requirements of the City Charter
of the said City of Miami Beach.
IN WITNESS WHEREOF I have hereunto set my hand and
affixed the official seal of the City of Miami Beach, Florida,
on this the 17th day of January, 1968.
