� AN ORDINANCE AIviENDING SECTIOI�T �10 34
OF "THE CODE OF THE C ITY OF t�IAMI
, BEACH, FLORIDA"
BE IT ORDAINED BY THE C ITY COUNC IL OF TY� C ITY OF' MIA1�I BEACH,
FLORID�o
SECTION la That Section �103� of"The Code of the City of
Miami Beach, Florida" be ancl the same is�hereby
amended to read as followso
"Section 1. Tax imposed; Amount. _
�1) An excise or privilege tax, in addition
to all other taxes of every kind imposed by law,
is imposed upon the sale, receipt, purchase, possession,
consumption, handling, distribution and use of
i cigarettes sold or to be sold at retail within the
territorial limits of the city in the following
amounts, except as otherwise provic�'ed by general
law, for cigarettes of stanc�ard dimensions�
(a) Upon all cigarettes, as herein definec�,
four inches long or less, five and one-half mills
on each cigaretteo �
(b) Upon all cigarettes, as herein definecl,
more than four inches long and not more than six
inches long, eleven mills on each cigarette.
(c} Upon all cigarettes, as herein c�efined,
more than six inches long, twenty--two mills on each
cigarette.
(2� The description of cigarettes cantained in
paragraphs (a} ,(�o) and { c) of subsection (1) are
hereby declared to :�e standard as to dimensions
for taxing purposes as provided in this ordinance
and should any cigarette be�received, purchased. possessed,
sold, offered for sale, given away or t�sed of a si2e
other than of stanc�arc� dimensions, the $ame shall be
taxed at the rate of ane cent on each such cigarette.
(3) �'here cigarettes as described in subsection
(1) (a) albove, are packed in varying quantities of
twenty (20) cigarettes or less, the following rate
shall governo
(a) Packages containing ten (10) cigarettes or
less require a five and one-half cent {5��) tax; and
(b) Packages containing more than ten (10} but
not more than t�Jenty (20) cigarettes require an
eleven cen� (11�) tax.

(b) Packages containing more than ten (10) but
not more than twenty (20) cigarettes require a
forty-four cent (���) tax.
SECTION 2e Al1 ordinances or parts of ordinances in conflict
herewith be and the same are hereby repealed.
SECTION 3. The health and welfare of the City being in peril,
the three reacxinys of this ordinance shall be
had in one session and the Cit�r Council finding that this
ordinance is necessary for the immediate protection of its
citizens, it shall therefore go into ef�ect on April l, 1968.

Ordinance No. 168g entitled:
"AN ORDINANCE AMENDING SECTION 41.34 oF 'THE CODE OF THE
CITY OF MIAMI BEACH, FLORIDA' "
having been passed and adopted by the City Council of the City of
Miami Beach, Florida, has been posted by me in three conspicuous
places in the City of Miami Beach, one of which was at the door
of the City Hall in said City on the 20th day of March, 1968,
and that said Ordinance remained posted for a period of at least
thirty days in accordance with the requirements of the City Charter
of the said City of Miami Beach.
IN WITNESS WHEREOF I have hereunto set my hand and
affixed the official seal of the City of Miami Beach, Florida,
