MIS CELLANEUUS OFFENS ES .
BE IT ORiaAINED 8Y THE CITY COUNCIL OF THE CITY OF MIAMI BFACH,
FI.ORIUA :
SECTION 1: T'hat Ghapter 25 of "T'he Code of the City of Miami
Beach, Florida" be amended by adding a new section
thereto, immediately follawi.ng Section 25.66, to be nu�nbered and
to read as foZlows:
Sec. 25.66.1 Temporary questioning of
persons in public places;
dangerous weapons search.
(a) A police officer may stop any
�erson abroad in a public place whom he has
probab le caus e to be 1 ieve may be co��romitt ing ,
may have cornmitted or is about to com�nit a
felony, and may demand of him his name, address
and an explanation of his actions.
(b) When a police officer has stopped a
person for questioning pursuant to this seetion
ans� when such golice officer has probable cause
to believe he is in danger of life or lisnb,
he xnay search such person for a dangerous
weapon. If the police officer finds such a
weapon, the possession of which may constitute
a crime, he may take and keep it until the
completion of the questioning, at which time
he shall either return it, if lawfully possessed,
or arrest such person. �
SECTION 2: That all ordinanaes or parts of ordinances in conflict
herewith be and the same are hereby repealed.
SECT24N 3: 'The health and welfare of the City being in peril
the three read ings of th is ord inance sha 11 be had in
one session and the City Council finding that this ordinance is
necesgary for the immediate protection of ita citizena it ,sball
therefore go into effect im�mediately upon its gassage.
