As used in this chapter, the term 'abandoned property' shall mean wrecked or derelict property l��ving no valtxe other than noaninal salvage value, i� anyo and which has been left unprotected from the elements and shall includ� wrecked, inoperative, or partially dismantled motor vehicles, trailer�, boats, machinery, refrigerators, washing machines, pl.umbing fixtures, furniture, and any other similar article which has no value other than nominal salvage value, if any, and which has been left unprotec�ed from the elemEnts. "Sece 25.62.2. It shall be unlawful for any person to put, place, or to permit to remain on any public or �arivate property in the City of Miami Beache any articZe which constitutes abandoned property, as the s�.:me i� defined in Section 25 .62 01. "S ec . 2 5 e 62 . 3 o T�Thenever the Chief of Pol ice shall ascertain that an art�.cle or articles of abandoned property are present on any public or private property within the lixnits of the City of Mi�mi Beach, he shall cause a notice to be placed upon such article in sul�stantially the following form: ' NOTICE TO THE OWNER A�1D ALL PERSONS INTERESTED IN THE ATTAGHED PROPERTY. 'This property, to wito (setting forth brief description) is unlawfuily upon (p�blic) or (private )(Chief of Police, or his duly appointed representative, to strike out inapplicable provision} praperty known as (setting forth brie� description of location), and must be removed within ten (1�) days tro�n date of this notice, otherwise it shall be presum�:d to be abandoned property and will be removed and destroyed by order ot the City of r�tiami Beach. Dated this : (setting forth date of pos�ing of notice)e S igneda (setting forth name, title, address and telephone number of Chief of Police or his duly appointed representativej.' "S uch noti�e shall be not less than eight inche� by ten inches (8" x 10" ) and shall be sufficiently weatherproof to withstand normal exp�sure to the elements. In additior� to posting, the Chief of Poli.ce sha13. :naxe reasonable effort to ascertain the name and address of the owner, and if such is reasonably av�ilox>�.c� t� the Chief of Poliee, he shall m:�.il a copy of such notice to the owner on or before the date of postingo -1- • � � ` • � r r s � r "If at the er�d of ten (10) days after posting such notice, the owner or any person interested in the abandon�ed article or articles desc�ibed in such notice has not removed the article or articles from public or private property or shown reasonable cause for failure so to do, the Chief of Police may cause the article or ar�icles of abandoned property to be removed and destroyed, and the salvage value, if any, of such article or articles shall be retained by the City of �Zia�ni Beach, to be applied against the cost oi removal and des�ruction thereof. "Sec. 25e62.4. 'Whoever opposes, obstructs, or resists the Chief af Police or any person authorized by the said Chief af Police in the discharge o� his duties as provided in this Chapter, upon conviction shall be punished in accordance with the provis ions of this Code . "Sec. 25.62.5. The Chief of Police or any person authorized by hi.m, shall be im►.-nune from gzosecution, eivil or criminal, for trespass upon any property while in the discharge or performance of duties imposed by Se�tions 25.62.3 and 25.62.4 of this Chaptere" SECi'ION 2: T.hat a11 ordinances or parts of ordinances in conflict herewith be and the same are hereby repeaied.
