HE IT O,R�DiAINED BY THE CITY COUN�IL OF THE CITY OF MIAt�+II BEACH,
FLORIDA:
SECTION 1 That "The Code' of the City of �tiami St:ach, F�or�,da" be
arid the sarn� is hereby a�nended by adding a new ch� pter
thereto to i�e numbered and to read as fo2loT�as :
"� ec . 2 4-A .1 License required .
"It shall be unlawful for any person to engage
within the City, in the business of �ontrol,
eradication or extermination of ter.mites or similar
insects, without having first been licensed by
the City Clerk and Finance Director to engage
therein. As a prerequisite for issuance, applicants
5ha11 provide proof of holding a current pest-control
business license from the S tate Board af Health.
"S ec . 2 aA . 2 License required ; fee .
"It shail be unlawful for any person to conduct
the said business, without having first paid the
license f�� and �aving procured a license fram the
City Clerk and Finance D irectar as required by its
license schedule in foree and effe�t at the ti�ne of
application �Qr such license.
"Sec. 2 0-A.3 Application for license; information
to be shown.
"Each and every person not less than six �6i
days before being licensed by the City Cierk and
Finance Direc�or to conduct any of the businesses
aforesaid, shall �ile with the City Clerk and
Finance Director an application requesting the
issuance of license to the applicant. which application
shall be signed and sworn to by the applicant bafore
a notary public and which application shall specify
the kind of business, the address of the intended
place of business of the applican� and the length of
time and the place or places where the agplicant has
b�en engaged in the business for which license is
applied.
"Sec. 2 4-Aa4 Examination and investigation of
applicationp granting or refusal of
licenseo
"The City Clerk and Finance D irector shall examine
and investigate every application far lieanse to
engage in bus ir�ess hereunder , and if it is made to
appear to the City Clerk and Finance Director that

"the state*nents in such applic$tion are true, the
license shall be issued upon the pa.yntent of the
license fee and filing af bond �r a eer�ificate of
insuranae as requ3xed in S ect ion 2�-A . 5 of tl�e Code �
"S ec . 2 0 A. 5 Bond or insurance pol icy required ;
procedure upon cancellation, etc.
"Every person engaged in any one or all of t�e
bus inesses enumerated in Section 2n A.1 af this Code,
shall be required to�!naintain at all times, a bond
or public liability and property damage insurance
with a minimum limit of not less than $10,�00.00
for injury to any one person, $2 0, Ot�O . 00 for in jur�
to �nore than one person in the same accident, and
$10,000.00 property darnage in any one a�cident. At
the time application is �nade and before a license
can be issued, such person shall file such bond or
a certificate signed by a qualified agent of an
insurance company authorized to do business in the
S tate of Florida, stating that a policy or policies
have been issued to such person for such public
liability and property damage insurance; the policy
number or numbers; the name of the company; the
effective and expiration dates of such policy or
policic�s; tbe amount of insurance and a statement
and a copy of an endorsement placed on such policy
or palicies and requiring thirty (30) days' wri�ten
notice by registered �nail to the City Clerk and
Finance D ire�tor if it becomes necessary far any
reason to cancel the policy or policies. In the
event of a cancellation of a policy or policies,
the City Clerk and Finance Director shall imYnediately
notify the liaensee, and the licensee shall be
required to furnish a new certificate in full
compliance with the terrns of this section within
ten (10) days fram the date of such notice. Failure
�so to do shall cons�itute a violatian of this section
and the iicense of such persan shall automatically
b e revoked. License may be reinstated by the City
Clerk and Finanee Director when the Licensee shall
have furnished a bond or new certificate of insurance
in compliance with this se�tion.
"Sec . 20 -A. 6 Permit fro�n Building Inspeetor - Required .
"Each and every licensee under the provisions of
this chapter, before he comnnences work upon each
job or contacact whiah he intends to do under the
license issued to him, shall file an application
in writing with the building inspector of the city
for a permit and shall obtain a permit fr�.n the
b uilding inspectar to do such work or contract;
provided that licensees hereunders where the
specific instance of operation �nvolves only household
insects or pests or other non-wood-destroying insects
or pests. shall not be required to comply with the
provisions of this sectio�.

applican� in the perfor�nance of such work or contract
and the name and address of the person intending to
empl.oy hi:rn to do such work or contract .
"Sec. 2Q-A.8 S�me - Fee.
"The applicant for a per�nit under Section 2 o A.6
of this Code shall also deposit with and deliver to the
Cit� Clerk and Finance Director contemporaneously with
the filing of the application foz a permit, the sum of
Five Dollars ($5.a0) lawful money of the United S tates
of Ameriea.
"See. 20 A.9 Inspection of premises and work
performed by 8uilding Inspectore
"The building inspector shall make such inspeetions
deemed necessary tv- i.nsure use of �nethods , equipment
and materials for the pratection of health and safety
of the general public fro�+n harmful and unnecessary
expasure to pesticides� and further to insure that only
those pesticides having Federal or S tate ],abel
registration are used strictly in accordance with the
product's registered labelo (Reference 482.051 F.S.}
"See. 20-A.14 Structural Fumigation for Control of
Dry Wood Termites and other wood-
da�naging insects -- Extended Safety Aeration Period
required.
"Immediately following fumigation of all dwelling
structures� an additional period of aeration is required,
in the interest of safety, after the structure has
been thoroughly aerated, properly monitored for residual
fu�nigant and determined safe for re-occupancy. Such
extenc�ed safety aeration period shall be not less
than one full additional riight, prior to human
re-occupancy of the fumigated structure.
"Sece 2p A.11 Licenses to be issued by City Clerk
and Finance D irector.
"Licenses issued by the City to engage i�a P or for
the conduct or operation of. a pest control business
including erad ication or extermination of terrnites and
other pests, shall be issued by the City Clerk and
Finance D irectoro

thirty days in accordance with the requirements of the City Charter
of the said City of Miami Beach.
