AN ORDINANCE AMENDING ORDINANCE NO. 845
OF THE CITY OF MIAMI BEACH, FLORIDA, �
� ENTITLED "AN ORDINANCE PROVIDING FOR
THE CREATION AND MAINTENANCE OF A
PENSION AND RETIREMENT SYSTEM FOR
CERTAIN EMPLOYEES OF THE CITY OF
� MIAMI BEA.CH, FLORIDA."
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI
. BEACH, FLORIDA:
SECTION l. That Section 5A.04.01 of Ordinance No.
� 845 be and the same is hereby amended
' to read as follows:
".Ol Before approval of any Disability
Retirement, the Physical Examiners shall
certify that the Employee Member is either mentally
i or physically incapacitated for the performance of
� his duty, that such incapacity is likely to be
! permanent, that such incapacity is the natural and
proximate result of injuries sustained in an
� accident which occurred at a definite time and
place while the Employee Member was engaged in the
' actual performance of his City duties,. and that
such Employee Member should be retired. The Physical
Examiners shall further certify that such incapacity
is not the result of habitual use of narcotics or
alcohol, misconduct, serv�;,� �rl the Armed Forces,
self-inflicted injury, or disability sustained
through other employment."
SECTION 2. That all ordinances, or parts of ordinances
in conflict herewith, be and the same are
� hereby repealed.
SECTION 3. That this ordinance shall go into effect
immediately upon its passage�and posting
as required by lawo

having been passed and adopted by the City Council of the City of
Miami Beach, Florida, has been posted by me in three conspicuous
places in the City of Miami Beach, one of which was at the door
of the City Hall in said City on the 5th day of October, 196g,
and that said Ordinance remained posted for a period of at least
thirty days in accordance with the requirements of the City Charter
of the said City of Miami Beach.
