Ordinance 1819• ORDINANCE NO. 1819 AN ORDINANCE AMENDING CHAPTER 36 OF "THE CODE OF THE CITY OF MIAMI BEACH" BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI, BEACH, FLORIDA: SECTION 1. That that portion of Section 36.3 of the Code of the City of Miami Beach, Florida reading as follows: "Sec. 36.3. Permit --Required. No sign described in paragraphs (b), (c), (d), (e) and (f) of section 36-10 shall be erected, constructed or reconstructed in the city without first having obtained a permit therefor from the city council and paying the fees set forth in this chapter." be and the same is hereby amended to read as follows: "Sec. 36.3. Permit --Required. No sign described in paragraphs (b), (c), (d), (e) and (f) of section 36-10 shall be erected, constructed or reconstructed in the city without first having obtained a permit therefor from the Chief Building Inspector and paying the fees set forth in this chapter." SECTION 2. That that portion of Section 36.3 of the Code of the City of Miami Beach, Florida reading as follows: "(8) Such other information as the city council shall require to show full compliance with this and all other laws and ordinances of the city." be and the same is hereby amended to read as follows: "(8) Such other information as the Chief Building Inspector shall require to show full compliance with this and all other laws and ordinances of the city." SECTION 3. That Section 36.7 of the Code of the City of Miami Beach, Florida, be and the same is hereby amended to read as follows: "Sec.36.7. Hazardous signs; appeals from decisions of chief building inspector. No permits shall be issued for signs which, in the opinion of the chief buiLd ng inspector, will constitute a hazard of any kind. An appeal from any decision of the chief building inspector may be taken by any aggrieved party to the City Manager; and appeals from decisions of the City Manager may be taken to the City Council, which decision in the matter shall be final. The City reserves the right, after forty-eight hours' notice, to remove any sign, which is not properly maintained, which shows neglect, becomes dilapidated or is, in the opinion of the chief building inspector, unsafe or hazardous in any way." SECTION 5. That Section 36.9 of the Code of the City of Miami Beach, Florida, reading as follows: "Sec. 36.9. Erection of signs in special cases. The city council may, in special cases, grant permits for the erection of signs not conforming to the requirements of this chapter, and, at their discretion, may require a bond not exceeding ten thousand dollars, protecting the city against all liabilities." be and the SECTION 6. SECTION 7. Attest: same is hereby repealed. That all ordinances or parts of ordinances in conflict herewith, be and the same are hereby repealed.
