AN ORDINANCE AMENDING ORDINANCE NO. 289,
COMMONLY KNOWN AS "TIIE ZONING ORDINANCE
OF THE CITY OF MIAMI BEACH, FLORIDA."
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1. That Section 5A of Ordinance No. 289, commonly
known as the "Zoning Ordinance or Miami Beach, Florida," be and
the same is hereby amended by adding thereto immediately following
the last: unnumbered paragraph thereof, the following:
"In the 'BAAA' to the 'BB' use districts, both
inclusive, as said use districts are defined in
this ordinance, no article or commodity shall
be exhibited, stored, or kept for the purpose
of sale, or offered for sale, from any building
which fronts, abuts, or is adjacent to any public
street, sidewalk or way unless said building shall
be completely enclosed; provided, however, that
nothing herein contained shall be applicable to
newspapers, periodicals, duly authorized and
licensed sidewalk cafes or art displays. Any build-
ing herein described, which does not conform to the
provisions hereof shall be permitted to continue in
ex i stenco for a period ending on January 1, 1971."
SECTION 2. All ordinances or parts of ordinances in conflict here-
with be and the same are hereby repealed.
SECTION 3. That this ordinance shall go into effect immediately
upon its passage and posting as required by law.

having been passed and adopted by the City Council of the City of
Miami Beach, Florida, has been posted by me in three conspicuous
places in the City of Miami Beach, one of which was at the door
of the City Hall in said City on the 26th day of June, 1970,
and that said Ordinance remained posted for a period of at least
thirty days in accordance with the requirements of the City Charter
of the said City of Miami Beach.
