Ordinance 18384 1838 ORDINANCE NO. AN ORDINANCE AMENDING ORDINANCE NO. 845 OF THE CITY OF MIAMI BEACH, FLORIDA, ENTITLED "AN ORDINANCE PROVIDING FOR THE CREATION AND MAINTENANCE OF A PENSION AND RETIREMENT SYSTEM FOR CERTAIN EMPLOYEES OF THE CITY OF MIAMI BEACH, FLORIDA." BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1. That Section 2.27.02 of Ordinance No. 845, being an ordinance providing for the creation and maintenance of a Pension and Retirement System for certain employees of the City of Miami Beach;• Florida, =be, and ' the same is hereby amended to read as follows: "02. Notwithstanding anything to the contrary in this ordinance, the Creditable Service of persons who became Employee Members of the System on or after January 1, 1970, shall include all periods of time of actual work for which wages or salaries were received by them from the City including all time served in the Unclassified Service of the City, 'and including any and all provisional, probationary, or regular work or employment, whether or not such periods of employment were continuous or interrupted, together with time spend in the military service for which Employee Contributions were made; provided, however, that as to persons who became Employee Members of the System, after January 1, 1970, Creditable Service shall not include provisional employment where the provisional employee does not immediately thereafter become an Employee Member of the System; provided, further, that Creditable Service shall also include periods of contractual employment where the board determines that said contractual employment was for more than thirty- five (35) hours per consecutive week, that during the contractual period the employee devoted his full time in the performance of his contractual duties, and that the contractual employment was immediately followed by appointment to the classified or unclassified service; and provided,' further, that such Creditable Service shall be credited to such Employee Member upon application therefor within one year of the time said Employee Member becomes a member of the System, and upon payment of the required 6% Employee Normal Contributions upon his theretofore uncredited service, together with compound interest at the rate of three percent (3%) upon such required Employee Normal Contributions, such payment to be made within one year of the time said Employee Member becomes a Member of the System."
