AN ORDINANCE AMENDING CHAPTER 16 OF THE
CODE OF THE CITY OF MIAMI BEACH, FLORIDA.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI
BEACH, FLORIDA:
Section 1: That the Code of the City of Miami Beach,
Florida, be and the same is hereby amended
by adding new sections thereto, to be numbered and to
read as follows:
"Section 16.52.3. It shall be unlawful
for any person to en-
gage in the business of selling or offering
to sell any food, food products, beverages
or merchandise held out to be kosher,
unless he shall have procured from the City,
in addition to the occupational license
required under the provisions of Chapter 20
of this Code, an annual special license,
licensing his place of business as a Kosher
Establishment. Said license shall be procured
from the City Clerk in the same manner as pro-
vided for by Chapter 20 of this Code and shall
be issued upon the payment of $ 115.00 , which
fee represents the reasonable cost of the
special supervision and regulation required of
such establishment. Any person violating the
terms of this section shall be subject to the
penalties provided by said Chapter 20.
"Section 16.52.4. The Municipal Judges of the
City of Miami Beach shall
have the right, in addition to any fine or
jail sentence, to suspend the special license
provided for by Section 16.52.3 for a period
within the discretion of the Court of from
one month to six months, in the event the
defendant is found guilty of a violation of
Section 16.49, 16.50 or 16.51 of this Chapter,
as a first offender. The Municipal Judge is
authorized and empowered to increase, in his
discretion, the period of suspension for
persons found guilty of subsequent violations
of said sections."
Section 2: That all ordinances or parts of ordinances in
conflict herewith be and the same are hereby
repealed.
Section 3: That this ordinance shall go into effect
immediately upon its passage and adoption
as required by law.

places in the City of Miami Beach, one of which was at the door
of the City Hall in said City on the 1st day of
July, 1970,
and that said Ordinance remained posted for a period of at least
thirty days in accordance with the requirements of the City Charter
of the said City of Miami Beach.
