Ordinance 1857ORDINANCE NO. 1857 AN ORDINANCE AMENDING CHAPTER 25 OF "THE CODE OF THE CITY OF MIAMI BEACH, FLORIDA." BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1. That Chapter 25 of "The Code of the City of Miami Beach, Florida," be and the same is hereby amended by adding thereto a new section, to be numbered and to read as follows: "Section 25.36.1 It shall be unlawful for any person to sell or distribute other than to established drugstores, any hypodermic syringe or needle adapted for the use of cocaine or narcotic drugs by subcutaneous injections other than by a prescription properly executed by a person authorized to execute prescriptions for medicines and drugs in accordance with the laws of the State of Florida." SECTION 2. If any word, clause, phrase, sentence, paragraph, or section of this Ordinance is held to be invalid by a Court of competent jurisdiction, such declaration of invalidity shall not affect any other word, clause, phrase, sentence, paragraph or section of this Ordinance. SECTION 3. All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 4. This ordinance shall go into effect immediately upon its passage and posting as required by law. Attest: PASSED and ADOPTED this 2nd day of December ,1970.
