ORDINANCE NO. 1862
AN ORDINANCE AMENDING SECTION
SECTION 7.16 OF "THE CODE OF
THE CITY OF MIAMI BEACH, FLORIDA".

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1. That Section 7.16 of "The Code of the City of
Miami Beach, Florida, be and the same is hereby
amended to read as follows:
"It shall be unlawful for any person to moor, anchor,
or tie up any houseboat to any dock, bulkhead, or pier
lying, being or situate in any areas or waterways in
the City of Miami Beach.
It shall also be unlawful for any person to reside upon
any boat anchored or tied to a dock within the following
lakes and inland waterways in the City:
Lake Pancoast Biscayne Waterway
Sunset Lake Surprise Waterway
Surprise Lake Flamingo Waterway
Collins Canal Normandy Waterway
Indian Creek
provided, however, that nothing herein contained shall
apply to any watchman who, in the performance of his
duties as such, attends to, or looks after, the safety
and security of such boat, but who shall not be permitted,
in the performance of his duties as such, to make his
place of abode thereon.
For the purpose of this section, a houseboat is hereby
defined as 'any boat or watercraft structurally designed
or built and fitted up as a house or dwelling, and
resembling a house or dwelling in form and arrangement,
and designed, used or intended to be used for permanent
or temporary human habitation as if such boat or
watercraft is a house or dwelling place:".
SECTION 2. That all ordinances or parts of ordinances in
conflict herewith be and the same are hereby
repealed.
SECTION 3. This ordinance shall go into effect four (4) months
after passage and posting as required by law.

Ordinance No. 1862 entitled:
AN ORDINANCE AMENDING SECTION 7.16 OF "THE
CODE OF THE CITY OF MIAMI BEACH, FLORIDA,"
having been passed and adopted by the City Council of the City of
Miami Beach, Florida, has been posted by me in three conspicuous
places in the City of Miami Beach, one of which was at the door
of the City Hall in said City on the 4th day of December, 1970,
and that said Ordinance remained posted for a period of at least
thirty days in accordance with the requirements of the City Charter
of the said City of Miami Beach.
IN WITNESS WHEREOF I have hereunto set my hand and
affixed the official seal of the City of Miami Beach, Florida,
on this the 20th day of January, 1971.
