Ordinance 424ORDINANCE NO. 424 AN ORDINANCE PROVIDING FOR THE INSPECT- ION AND/OR REFILLING OF FIRE EXTINGUISH- ERS REQUIRED BY LAW TO BE KEPT UPON PREMISES LOCATED IN THE CITY OF MIAMI BEACH; PROVIDE THAT SUCH INSPECTION AND/OR REFILLING OF SUCH FIRE EXTINGUISH- ERS BE MADE BY ONE OR LORE INSPECTORS AUTHORIZED AND APPROVED BY THE CHIEF OF THE MIAMI BEACH FIRE DEPART TNT; REQUIR- ING THE REPAIR OR REPLACEMENT OF ANY FIRE EXTINGUISI-R FOUND UPON INSPECTION TO BE DEFECTIVE; PRESCRIBING ANNUAL FEES TO BE CHARGED AND COLLECTED FOR SUCH INSPECTIONS; ESTABLISHING CHARGES TO BE MADE FOR REFILL- ING FIRE EXTINGUISHERS; PROVIDING PENALTIES FOR REFUSING TO PERMIT SUCH INSPECTIONS AND/ OR PAY THE INSPECTION FEES PRESCRIBED BY THIS ORDINANCE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIA:;:I BEACH, FLORIDA: SECTION 1. In the interest of public safety and the protection of property and for the prevention, elimination and reduction of fire hazards, every fire ex- tinguisher required by law to be kept upon any premises in the City of Miami Beach shall be inspected at least once during every year by one (1) or more inspectors, authorized and approved by the Chief of the Miami Beach Fire Department. SECTION 2. Every fire extinguisher included within the purview of Section 1, hereof, which upon in- spection, is found to be defective and/or unfit for the service for which it is required by law to be kept upon the premises, shall immediately be repaired or replaced by a serviceable extinguisher and the person legally required to keep such extinguisher upon the premises shall have such repairs or replacement made in accordance with instructions issued by the inspector by whom such extinguisher is de- clared to be defective. SECTION 3. An .annual fee of Thirty -Five Cents (350) for the inspection of any fire extinguisher des- crtbed in Section 1 hereof is hereby levied and assessed as an inspection fee to provide for the proper supervision and inspection of every such fire extinguisher by the City 1 of Miami Beach. The said annual inspection fee of Thirty - Five Cents (35¢) for each fire extinguisher as prescribed by this section shall be paid annually to the inspector by the person legally required to keep such extinguisher upon the premises. At the time of the collection of any annual inspection fee, the inspector receiving pay_ enre shall issue and attach to the fire extingai.shei', for which the tnspecti.on fee has been paid, an inspection certificate sh.orai lig, the date of inspection, the amount paid and the name of the inspector by whom the inspection was rade. SECTION 4 When upon inspection, any fire extinguisher described in Section 1 hereof is found to be in need of refilling with the chemical solution intended and/or required by law to be used therein, the person legally required to keep such extinguisher upon the premises shall cause the same to be refilled immediately with the proper chemical solution. At the option of such person, such refilling may be done either by an individual, firm or corp- oration approved by the Chief of the Miami Beach Fire Depart- ment, selected by such person, or by the inspector who has determined that such refilling is necessary. In the event that any person legally required to keep one (1) or more fire extinguishers upon premises located in the City of Miami Beach, shall authorize and instruct an inspector as herein described to refill any such fire ex- tinguisher, such person shall pay to the inspector at the time of refilling of such extinguisher the appropriate re- filling charge as shown by the following schedule. Charge for refilling 22 gallon soda -acid extinguisher $ .15 n 40 1.50 u n u S0 it it n n 2.50 1 quart tetra. chloride " 1.50 " " 22 gallon Foanzite " 1.15 i� ►� ft 40 it it ri 15.50 - 2- At the time of refilling and after collection of the re— filling charge, the inspector to whom said charge is paid shall issue and attach to the fire extinguisher for which the said refilling charge has been paid, a certificate, showing the date the refill was made and the name of the inspector making such refill. Any fire extinguisher which has been refilled by en in- spector as provided in this section and the contents of which after refilling are used for the purpose of extinguishing a fire, shall be refilled again by the same or another inspector without any charge being rade therefor. SECTION 5. The Chief of the Fire Department of the City of Miami Beach shall be in charge of and responsible for the inspection and/or refilling of any fire extinguisher for which provision is herein made and shall establish and maintain records, which shall be adequate to show at all times the location of every fire extinguisher described in Section 1 hereof, the serial number stamped or shown thereon, the date when such extinguisher was last inspected and/or refilled in accordance with the provisions of this ordinance and the name of the inspector who made such last inspection and/or refilling. SECTION 6. Every person who violates or fails to comply with any of the provisions of this ordinance shall be punishable by a fins: not exceeding Fifty Dollars ($50.00) or by imprisonment not exceeding 30 days, or by both such fine and imprisonment in the discretion of the Municipal Judge. SECTION 7. If any section, part of section, sentence, clause or phrase of this ordinance shall be held to be unconstitutional or invalid, the remaining provisions hereof shall nevertheless remain in full force and effect. SECTION 8. All ordinances or parts of ordinances heretofore adopted and which are inconsistent or in conflict with the provisions of this ordinance be and the same are hereby repealed. -3- PASSED AND ADOPTED the 1st day of April, A. D., 1936, and that said Ordinance remained posted for a period of at least thirty days in accordance with the require- ments of the City Charter of the said City of Miami Beach.
