AN ORDINANCE RATIFYING, ADOPTING, CON..
FIRMING AND RE-ORDAINTNG THF FORMER
CLOSING IN 1915 BY THk TOWN COUNCIL OF
THE TOWN OF MIAMI BEACH, A PORTION OF
FIFTEENTH STREET AND SIXTEENTH STREET
BETWEEN WASHINGTON AVENUE AND COLLINS
AVENUE.
WHEREAS, heretofore, on the 15th day of January, A. D.,
1914, the Alton Beach Realty Company did cause a plat of a
certain subdivision known as Fisher's First Subdivision of
Alton Beach to be recorded in the Public Records of Dade
County, Florida, in 'Plat Book 2 at Page 77 thereof, and
WHEREAS, thereafter, and prior to the opening of any
streets in said subdivision, the Town Council of the Town of
Miami Beach did, on the 24th day of March, A. D., 1915, enact
an ordinance of said. Town vacating, discontinuing and abolish—
ing certain alleys and portions of streets in said subdivision,
and
WHEREAS, one of the streets so vacated, discontinued and
aboli shad by said ordinance was "Avenue D" as marked, platted
and designated on that certain plat of Fisher's First Sub—
division of Alton Beach, recorded in Plat Book 2 at Page 77
of the Public Records of Dade County, Florida, and
WHEREAS, "Avenue D" is now known and designated as "Fifteenth
Stree t" , and
WHEREAS, the said "Avenue D" or "Fifteenth Street" between
Atlantic Boulevard, now known as "Collins Avenue" and Miami
Avenue, now known as "Washington Avenue,"has, at all times, been
closed to the public, and
WHEREAS, said portion of "Avenue D" or "Fifteenth Street" is
now improved by the construction of dwellings and the planting of
ornamental trees and shrubbery, and
WHEREAS, the public at large has acquiesced in and consented
to
the vacation, discontinuance and abolishment of said portion
of said street, and
WHEREAS, any attempt on the part of the City of Miami
Beach to reopen said street would not be to the interest of
the public, and would result in great loss to private in-
dividuals who have improved and occupied the same in the belief
that they had good title and right thereto;
AND WHEREAS, one of the streets so vacated, discontinued
and abolished by said ordinance was "Avenue C" as marked,
platted and designatad on that certain plat of Fisher's First
Subdivision of Alton Beach, recorded in Plat Book 2 at Page ?7
of the Public Records of Dade County, Florida, and
WHEREAS, "Avenue C" is now known and designated as "Six.•
teenth Street" , and
WHEREAS, the said "Avenue C" or "Sixteenth Street" between
Atlantic Boulevard, now known as "Collins Avenue" and Miami
Avenue, now known as "Washington AvenueTM, has, at all times,
been closed to the public, and
WHEREAS, said portion of "Avenue C" or "Sixteenth Street"
is now improved by the construction of dwellings and the plant..
ing of ornamental trees and shrubbery, and
WHEREAS, the public at large has acquiesced in and consented
to the vacation, discontinuance and abolishment of said portion
of said street, and

who have improved and occupied the same in the belief that they

NOW, THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI
BEACH, FLORIDA, THAT:
Section 1. The action of the Town Council of the Town
of Miaai Beach, on March 20th, 1915, vacating, discontinuing
ami► dishing "Avenue D", now known as "Fifteenth Street",
lieWssue 0, now known as "Sixteenth Street", between
Atlantic boulevard, now known as "Collins Avenue" and 'Miami
Aventv, ZOO known as "Washington Avenue", be, and the same is
hereby ratified, adopted, confirmed and re -ordained.
Section 2. That portion of "Fifteenth Street", formerly
known and designated as "Avenue D" on that certain map or
plat recorded in Plat Book 2 at Page 77 of the Public Records
of Dade County, Florida, and that portion of "Sixteenth Street",
formerly known and designated as "Avenue C" on said map or
plat recorded in Plat Book 2 at Page 77 of the Public Records
of Dade County, Florida, between Collins Avenue, formerly
known as "Atlantic Boulevard" and Washington Avenue, formerly
known as "Miami Avenue", be, and the same is hereby vacated,
discontinued and abolished, and the City of Miami Beach does
hereby relinquish and/or disclaim any interest in and to said
property so designated as said street which it might have had
or acquired in any manner whatsoever.
Section 3. All ordinances or parts of ordinances in
conflict herewith are hereby repealed.
Section 4. This ordinance to take effect thirty days
after posting.

certify that Ordinance No. 431 entitled AN ORDINANCE
RATIFYING, ADOPTING, CONFIRMING AND RE -ORDAINING THE
FORMER CLOSING IN 1915 BY THE TOWN COUNCIL OF THE TOWN
OF MIAMI BEACH, A- PORTION OF FIFTEENTH STREET AND
SIXTEENTH STREET BETWEEN WASHINGTON AVENUE AND COLLINS
AVENUE", having been passed and adopted by the City
Council of the City of Miami Beach, Florida, has been
posted by me in three conspicuous places in the City
of Miami Beach, one of which was at the door of the City
Hall in said City on the 4th day of June, A. D., 1936,
and that said Ordinance remained posted for a period of
at least thirty days in accordance with the requirements
of the City Charter of the said City of Miami Beach.
IN WITNESS WHEREOF I have hereunto set
my hand and affixed the official seal of the City of
Miami Beach, Florida, on this the 14th day of July, A. D.,
1936.
