Ordinance 441ORDINANCE NO. 441 AN ORDINANCE TO PROVIDE FOR THE SEIZURE, STORAGE AND SALE OF AUTOMOBILES FOUND ABANDONED UPON ANY OF THE PUBLIC STREETS AND HIGHWAYS OF THE CITY OF MIAMI BEACH, FLORIDA. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: That the Police Department of the City of Miami SECTION 1: Beach, Florida, is hereby authorized and directed to seize and reduce to the possession of said Police Department any automobiles, whether stolen, wrecked or otherwise abandoned, which may be found upon any of the public streets and highways of the City of riami Beach, and to store said automobiles as hereinafter provided. That the City of Miami Beach shall provide SECTION 2: a storage garage or warehouse where the auto- mobiles seized under the provisions of this ordinance shall be stored and kept for a period of sixty (60) days from the date of such seizure. During said. Period of sixty (60) days the SECTION 3: Police Department shall make proper effort to notify the owner or owners of any of said automobiles that the same are being retained under the Provisions of this ordinance, and shall, throughout said period of sixty (60) days, permit the owner or owners to regain 'Possession thereof upon proof of ownership and upon payment of the storage charges and costs connected with the seizure and storage of said auto- mobiles. After the expiration of said period of sixty SECTION 4: days the City Manager shall sell any such automobile not claimed or reduced to possession by the owner thereof, at public sale after ten days' notice in writing to the owner if he can be found or by advertising once in a newspaper of general circulation in the City of Miami Beach, Florida. Out of the proceeds of the sles of any such SECTION 5: automobile or automobiles, costs and storage shall be first paid and any balance remaining shall be retained by the City of 7iami Beach in a special fund in the possession of the said City for a Period of one year in order to enable the owner or owners of said automobile or automobiles to prove ownership of said automobile so sold, and when such owner- ship is Proved such surplus funds shall be Paid to the said owner. SECTION 6: accordance After the expiration of one year as in the paragraph next preceding provided, any sums arising from the sale of automobiles in with the provisions of this ordinance which are un- claimed by the owner or owners of said automobiles shall be transferred to the general funds of the City of Miami Beach, Florida. D. 1936, and that said Ordinance remained posted for a period of at least thirty days in accordance with the requirements of the City Charter of the said City of Miami Beach.
