AN ORDINANCE OF THE CITY OF MIAMI
BEACH, FLORIDA, AMENDING ORDINANCE
NO. 394, AS AMENDED, BEING AN ORDI-
NANCE OF THE CITY OF MIAMI BEACH,
FLORIDA, IMPOSING LICENSES AND OTHER
TAXES ON PRIVILEGES, BUSINESSES, OC-
CUPATIONS AND PROFESSIONS CARRIED ON
AND ENGAGED IN WITHIN SAID CITY, AND
PRESCRIBING PENALTIES FOR THE EXER-
CISING OF SUCH PRIVILEGES OR CARRYING
ON SUCH BUSINESSES, OCCUPATIONS, OR
PROFESSIONS, WITHOUT A LICENSE OR
OTHER FAILURE TO COMPLY WITH THE PRO-
VISIONS THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1: That Section 5 of Ordinance No. 394, be and the same
is hereby amended, under the title "AMUSEMENT AND
RECREATION", by eliminating certain items therefrom
and inserting certain items in lieu thereof as
follows:
Eliminat ing:
"CORN, KENO, FORTUNE or similar games, with
standing or seating capacity accommodating
75 or less patrons . . . . .
The same accommodating over 75 patrons shall
pay an additional fee of $10.00 for each ad-
ditional patron accommodated. (All licenses
for Corn, Keno, Fortune or similar games, sub-
ject to the approval of the City Council.) "
Inserting in lieu thereof:
"CORN, KENO, FORTUNE or similar games with
standing or seating capacity accommodating
75 or less patrons $1,000.00
The same accommodating over 75 patrons shall
pay an additional fee of $15.00 for each ad-
ditional patron accommodated. (All licenses
for Corn, Keno, Fortune or similar games,
subject to the approval of the City Council.)"
Eliminating:
"FORTUNE TELLERS, Palmists, Hypnotists, Clair-
voyants, Astrologers, Phrenologists, Physiog-
nomists, Numerologists, Mind Readers and others
of a similar nature, whether or not in connec-
tion with another business, each . . . $ 50.00
Inserting in lieu thereof:
"FORTUNE TELLERS, Palmists, Hypnotists, Clair-
voyants, Astrologers, Phrenologists, Physiog-
nomists, Numerologists, Mind Readers and
others of a similar nature, whether or not in
connection with another business, each . . . . . $ 100.00
Eliminating:
"NIGHT CLUBS OR SUPPER CLUBS - Restaurants,
Dining Rooms or other establishments where
floor show or other form of entertainment is
provided for guests after 11:00 P. M., shall
ay a license fee of ONE THOUSAND DOLLARS
($1,000.00) in addition to --their regular
RESTAURANT LICENSE.

"NIGHT CLUBS OR SUPPER CLUBS - Restaurants, Dining
Rooms or other establishments where floor show or
other form of entertainment is provided for guests
after 11:-- P. M., shall pay a license fee of TWO THOU-
SAND DOLLARS ($2,000.00) in addition to their regular
RESTAURANT LICENSE."
Eliminating:
"THEATRES, other than Moving Picture, etc. $ 50.00
Burlesques or other similar performances,
subject to approval by the City Council,

Inserting in lieu thereof:

"SECTION 2: That Section 5 of Ordinance No. 394, be and the same
is hereby amended, under the title "LIVING ACCOMMODATIONS"
by eliminating certain items therefrom and inserting cer-
tain items in lieu thereof as follows:
Eliminating:
"APARTMENTS, APARTMENT HOUSES OR HOTELS, containing over
five (5) bedrooms, for each room which can be leased,
not including bathrooms or kitchens $ .25
Providing that each such apartment house, etc., shall
pay a minimum fee of $ 5.00"
Inserting in lieu thereof:
"APARTMENTS, APARTMENT HOUSES OR HOTELS, OR ROOMING
HOUSES, containing over 2 (two) bedrooms, for each
room which can be leased, not including bathrooms
or kitchens $ .50
Providing that each such apartment house, etc.,
shall pay a minimum fee of"

SECTION 3: That Section 5 of Ordinance No. 394, be and the same is
hereby amended, under the title "MANUFACTURERS", by
eliminating certain items therefrom and inserting cer-
tain items in lieu thereof as follows:

FACTORIES employing more than five and not

posted by me in three conspicuous places in the City of Miami
Beach, one of which was at the door of the City Hall in said
City on the 22nd day of September, A. D., 1936, and that said
Ordinance remained posted for a period of at least thirty days
in accordance with the requirements of the City Charter of the
said City of Miami Beach.
