Ordinance 448ORDINANCE NO. 1.48 AN ORDINANCE OF THE CITY OF MIAMI BEACH, FLORIDA AMENDING ORDINANCE NO. 371, BEING AN ORDINANCE CREATING THE BOXING COMMIS- SION OF THE CITY OF MIAMI BEACH FOR THE REGULATING AND SUPERVISING OF PUGILISTIC, WRESTLING OR OTHER SIMILAR PUBLIC EXHIBI- TIONS, PROVIDING FOR PERMITS FOR THE PROMOTING AND CONDUCTING OF SUCH EXHIBI- TIONS AND THE GRANTING OR DENYING OF SUCH PERMITS BY THE COMMISSION, AND PROVIDING FOR A PENALTY FOR VIOLATING THE TERMS OF SAID ORDINANCE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: Section 1: That paragraph 1 of Section 2 or Ordinance #371 of the City of Miami Beach, Florida, be and the same is hereby amended to read as follows: Section 2: A Commission is hereby created to be known as the Boxing Commission of the City of Miami Beach, whose duty it shall be to administer and provide for the enforcement of all the provisions of this ordinance. Said Commission shall consist of three members to be appointed by the City Council of the City of Miami Beach, any two of whom shall constitute a quorum. In the event that any one or more of the regular commissioners shall for any reason be unable to perform the duties of a commissioner, then in that event the chairman of the commission, with the consent of the city manager, may appoint a substitute commissioner or commis- sioners to act for such time as such regular commissioner or com- missioners shall be unable to serve. They shall serve during the pleasure ofthe City Council. Said. Commission shall have its office in the City Hall in the City of Miami Beach, and in rooms to be provided by the City for that purpose, and all of its records shall be there kept. Said Commission shall hold meetings upon such days as may be determined on by the Commission and may hold special meetings upon the call of the Chairman or any two members. It shall keep a complete record of all its meetings, all its acts and all the business it transacts, and may prepare all necessary regulations and blank forms for the conducting of its business. Section 2: That paragraph "A" of Section 4 of said Ordinance #371 be and the same is hereby amended to read as follows: Section 4 "A": No permit shall be issued by the Boxing Commission unless application therefor shall be first filed with said Commission in writing and filed with said Commission on or before five days prior to the date on which any such exhibition is intended to be held, with the right nevertheless for the Commission to alter the time within which said application shall be filed. Such application shall be upon forms prescribed by the Commission for that purpose, and signed by the person or persons intending to conduct or promote such exhibitions; if the applicant is a corpor- ation, the application shallbe signed in the corporate name by the President thereof; if the applicant is a partnership or association the application shall be signed by a member of such partnership or association. -1- Section 3: That paragraph (a) of sub -section 0C9 of Section 4 of said ordinance #371 be and the same is hereby amend- ed to read as follows: (a) The name, age and residence of the applicant, and his sponsor who must be one of the following: American Legion Disabled American Veterans, Veterans of Foreign Wars of the United States, Spanish-American War Veterans, or Companies or Detachments of the Florida National Guard, Y.M.C.A., or any College which is a member of any recognized Amateur Athletic Association and the Circulo Cubana Club, a charitable organization now in existence. Section 4: That Section 5 of said Ordinance #371 be and the same is hereby amended by adding thereto the following par- agraph: The Commission shall have the power to suspend any con- testant, fine him or cause his purse to be forfeited for violation of any of the provisions of this Ordinance or the rules of the Commission; all such fines and forfeitures shall be turned over by the Commission after ninety days to the Welfare Department of the City of Miami Beach for charity purposes. Nothing herein shall be construed to limit the power of the Commission to suspend any other person who might come under its jurisdiction. Section 5: All ordinances and parts of ordinances in conflict here- with are hereb: repealed. PASSED AND ADOPTED this 24th day of Sept „ A.D. 1936. TOMLINSON, City Clerk in and for the City of Miami Eeach, Florida, do hereby certify that Ordix.ance No. 448 entitled "AN ORDINANCE OF TIE CITY OF MIAMI BENCH, FLORIDA, AMENDING ORDINANCE NO. 371, BEING AN ORDINANCE CREATING THE BOXING COMMISSION OF THE CITY OF MIAMI BEACH FOR THE REGULA- TING AND SUPERVISING OF PUGILISTIC, WRESTLING OR OTHER SIMILAR PUBLIC EXHIBITIONS, PROVIDING FOR PERMITS FOR THE PROMOTING AND CONDUCTING OF SUCH EXHIBITIONS AND THE GRANTING OR DEWYING OF SUCH PERMITS BY THE COMMISSION, AND PROVIDING FOR A PENALTY FOR VIOLATING THE TERMS OF SAID ORDINANCE," having been duly passed and adopted by the City Council of the City of Miami beach, Florida, has been posted by me in three conspicuous places in the City of Miami Beach, one of which was at the door of the City Hall in said City on the 25th day of September, A. D., 1936, and that said Ordinance remained posted for a period of at least thirty days in accordance with the requirements of the City Charter of the said City of Miami Eeach.
