ORDINANCE NO.
AN ORDINANCE OF THE CITY OF MIAMI BEACH,
FLORIDA, VACATING A PORTION OF FOURTEENTH
(14th) STREET IMMEDIATELY NORTH OF LOT 16,
BLOCK 39 OCEAN BEACh,FLORIDk 'ADDITION N0.3,
AND GRANTING SUCH VACATED PORTION THEREOF
TO W. H. WALKER, HIS HEIRS, LEGAL REPRESENT-
ATIVES AND ASSIGNS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1. That the following described portion of Fourteenth
(14th) Street, lying East of Pennsylvania Avenue and
West of Drexel Avenue and immediately North of Lot Sixteen (16)
Block Thirty-nine (39), OCEAN BEACH, FLORIDA, ADDITION NO. 3, describ-
ed as follows:
Beginning at a point 24.7 feet East of the N.W.
corner of LOT SIXTEEN (16) , BLOCK THIRTY-NINE
(39), OCEAN BEACH, FLORIDA, ADDITION NO. 3,
according to Plat thereof recorded in Plat Book
2, Page 81 of the Public Records of Dade County,
Florida; thence North .1 feet to the N.W. corner
of the building known as the "Everglades"; thence
East along the line of the said "Everglades" as
now located 32 feet, more or less, to the NE cor-
ner of the West "ell" of said "Everglades"; thence
South .1 feet, more or less, to the North line of
said Lot 16; thence West along the liorth line of
said Lot 16 to the place of beginning. ALSO,
beginning at a point on the North line of Lot 16,
Block 39, OCEAN BEACH, FLORIDA, ADDITION No. 3,
according to Plat thereof recorded in Plat Book 2,
Page 81, Public Records of Dade County, Florida;
which is .15 feet West of the NE corner of said
Lot 16; thence North .1 feet, more or less, to
the NE corner of the "Everglades" apartment
building as now located on said lot; thence West
42 feet, more or less, to the NW corner of the
East "ell" of the "Everglades" aforesaid; thence
South .1 feet to the North line of Lot 16; thence
East along the North line of said Lot 16 to the
point of beginning.
be and the same is hereby vacated and the use of such vacated por-
tion of said Street be and the same is hereby granted to W. H. W
his heirs, legal representatives and assigns, subject to the proviso
hereinafter contained.
PROVIDED, HOWEVER, that if the building now on said
premises and covering the above described land is ever moved,
demolished, destroyed by fire or rebuilt, then the above vacation
of said portion of Fourteenth (14th) Street, and the grant of the
use of the same shall be immodiately revoked, terminated and
absolutely voided, without any action on the part of the Citi;.,,,
Council of the City of Miami Beach, Florida, and said land above
described shall then again become a portion of Fourteenth Street
for the public use.

fy that Ordinance No. 261, entitled, "AN ORDINANCE OF
THE CITY OF MIAMI BEACH, FLORIDA, VACATING A PORTION
OF FOURTEENTH (14th) STREET ThI: EDIATELY NORTH OF LOT
16, BLOCK 39 OCEAN BEACH, FLORIDA, ADDITION NO. 3, AND
GRANTING SUCH VACATED PORTION THEREOF TO W. H. WALKER.,
HIS HEIRS, LEGAL REPRESENTATIVES AND ASSIGNS." having
been duly passed and adopted by the City Council of the
City of Miami Beach, Florida, has been posted by me in
three conspicuous places in the City of Miami Beach, one
of which was at the door of the City Hall in said City
on the 7th day of November, A. D., 1928, and that said
ordinance remained posted for a period of at least thir-
ty days in accordance with the requirements of the City
Charter of the said City of Miami Beach.
IN WITNESS WHEREOF, I have hereunto set
my hand and affixed the official seal of the City of
Miami Beach on this the 12th day of December, A. D., 1928.
