13005 RESOLUTION NO. 13005
WHEREAS, on July 12, 1968, one Jesse Lee Jackson,
while employed as a Laborer by the City of Miami Beach,
was injured removing a manhole cover from a truck, and
WHEREAS, said Claimant was examined or treated by
Drs. Grossman, Hall, Koch, Russell, Tobis, Mt. Sinai
Hospital and Cedars of Lebanon Hospital at request of the
City and by Dr. Christian Keedy at the request of Claimant ' s
attorney, and
WHEREAS, both Dr. Russell and Dr. Keedy evaluated
Mr. Jackson as having a 20% permanent partial disability of
the body as a whole, and
WHEREAS, it is felt by the Legal Department that it
is in the best interest of the City to enter into a settle-
ment under the provisions of FSS 440. 20 (10) , as amended,
1967, such settlement to be for $3260. 25 ($4, 226. 25 less
$966.00 paid to Claimant) representing 25% permanent partial
disability of the body as a whole at the Claimant ' s compensation
rate of $48. 30 per week for 87 .5 weeks, together with $1, 900. 00
for a reasonable attorney' s fee, $75.00 for an expert witness
fee, $50.00 for neurosurgical examination of Claimant and
$20.00 for court reporter costs, which is a total of $6, 271. 25
for which sum the City of Miami Beach will be responsible, and
WHEREAS, the Order of the Judge of Industrial Claims
approving said settlement stipulation will not be subject to
modification or review under the provisions of FSS 440. 28,
as amended, 1967, or as otherwise provided by law, and
WHEREAS, the City Council deems it to be in the best
interest of the City to enter into a final settlement stipulation
as herein before set forth,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF MIAMI BEACH, FLORIDA, that the Legal Department
be, and it is hereby authorized and directed to enter into
final settlement stipulation with Jesse Lee Jackson and his
attorney, and if said stipulation is approved by a Judge of
Industrial Claims, the Mayor, City Clerk-Finance Director and
the City Attorney be, and they are hereby authorized and
directed to comply with the Order of the Judge approving said
stipulation.
