13006 RESOLUTION NO. 13006 WHEREAS, on June 27, 1969, one Warren Roberson, while employed as a driver by the City of Miami Beach, was driving a trash truck which was involved in a multiple vehicle accident, and WHEREAS, said employee was examined or treated by Drs. Grossman, Moriber, Tobis and Parkway General Hospital, all at the request of the City, and WHEREAS, Drs. Moriber and Tobis diagnosed Mr. Roberson as having an acute lumbar strain with a minimal permanent partial disability rating of the body as a whole, and WHEREAS, a minimal permanent partial disability rating of the body as a whole is customarily equal to 5% % to Tilt, and WHEREAS, it is felt by the Legal Department that it is in the best interest of the City to enter into a settlement under the provisions of FSS 440.20 (10), as amended, 1967, such settlement to be in the total amount of $1,124.75. $857.50 of this amount for a 5% permanent partial disability of the body as a whole and all past, present or future compen- sation and medical benefits due Mr. Roberson. A reasonable attorney's fee of $257.25 and court reporter costs of $10.00 for the balance, and WHEREAS, the Order of the Judge of Industrial Claims approving such settlement stipulation will not be subject to modification or review, and WHEREAS, the City Council deems it to be in the best interest of the City to enter into a final settlement stipulation as herein before set forth, NOW, THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF MIAMI BEACH that the Legal Department be authorized to enter into final settlement stipulation with Warren Roberson and his attorney, and if said settlement is approved by a Judge of Industrial Claims, the Mayor, City Clerk-Finance Director and the City Attorney be, and they are hereby authorized and directed to comply with the Order of the Judge approving said stipulation.
