13015 RESOLUTION NO. 13015
WHEREAS, the City Council of the City of Miami Beach,
Florida, duly called a special election to be held in the City
of Miami Beach for the purpose of submitting to the duly qualified
electors of the City for their approval or rejection of the
proposal that the following parcel of land, to wit:
"Lots 15 through 20, Block 111,
OCEAN BEACH ADDITION NO. 3, Plat
Book 2, Page 81, of the Public Records
of Dade County, Florida"
should be conveyed to the Miami Beach Housing Authority for
use as Low Rent Housing for the Elderly, under Turnkey
contractual procedures authorized by the United States Housing
Act of 1937, as amended, either at a nominal consideration,
or in no event at more than the value of said land as approved
by the Department of Housing and Urban Development and payable
upon such terms as may be prescribed by the City Council, and
WHEREAS, said special election was duly held on
April 23, 1970, and
WHEREAS, the official canvass of the results of
said special election showed that the number of votes cast in
favor of the proposal was 9, 982 and that there were 5, 990 votes
cast against the said proposal, and
WHEREAS, pursuant to said canvass of the said results
of the said election, the City Council of the City of Miami
Beach, Florida, did find, determine and declare that the electors
of the City of Miami Beach had duly voted in favor of the said
proposal.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY
COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that upon the
approval by the Department of Housing and Urban Development
of the hereinabove described parcel of land as the site upon
which there shall be constructed two hundred (200) living units
for use as Low Rent Housing for the Elderly, under Turnkey
contractual procedures as hereinabove described, and upon
payment to the City of Miami Beach of the sum of one hundred
thousand ($100, 000. 00) dollars upon such terms as shall be
mutually agreed upon as the duly determined consideration for
said conveyance, the Mayor and the City Clerk be and they are
hereby authorized and directed to execute and deliver the said
deed at such time and such place as shall be requested or required
by the Miami Beach Housing Authority and the official representatives
of the Department of Housing and Urban Development.
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MIAMI BEACH, FLORIDA, that the said deed of conveyance
shall be in the usual warranty form, or in such other form as
may be desired and requested by the Miami Beach Housing Authority
and the Department of Housing and Urban Development, provided,
however, that such deed of conveyance shall set forth and provide
the condition that the said conveyance is made for use as Low

Rent Housing for the Elderly under Turnkey contractual procedures
authorized by the United States Housing Act of 1937, as amended,
and that upon failure or default in such condition, said
conveyance shall be deemed null and void and the title to said
parcel of land shall thereupon revert to the City of Miami Beach.
