13041 RESOLUTION NO. 13041 WHEREAS , the City Council of the City of Miami Beach, Florida, deems it to be necessary for the welfare of said City and the in- habitants thereof, to acquire for an ocean front public park the following described parcels of land situate, lying and being in Miami Beach, Dade County, Florida, to wit: PARCEL NO. ONE Lots 5 and 6, Block 1, ALTOS DEL MAR NO. 1, according to the Corrected Plat thereof, recorded in Plat Book 31, at page 40 of the Public Records of Dade County, Florida; PARCEL NO. TWO Lot 5, Block 2, ALTOS DEL MAR NO. 1, according to the Corrected Plat thereof, recorded in Plat Book 31, at page 40 of the Public Records of Dade County, Florida; PARCEL NO. THREE Lot 6, Block 3, ALTOS DEL MAR NO. 2, according to the plat thereof, recorded in Plat Book 4, at page 162 of the Public Records of Dade County, Florida; PARCEL NO. FOUR Lots 3 and 4, Block 4, ALTOS DEL MAR NO. 2, ac- cording to the plat thereof, recorded in Plat Book 4, at page 162 of the Public Records of Dade County, Florida; PARCEL NO. FIVE Lot 1, Block 5, and Lot 2, Block 6, ALTOS DEL MAR NO. 2, according to the plat thereof, recorded in l Plat Book 4, at page 162 of the Public Records of Dade County, Florida; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that it is necessary that the fee simple title to the above described property be acquired for use and maintenance for ocean front public park purposes for the benefit of said City and its inhabitants; BE IT FURTHER RESOLVED that the City Attorney be and he is authorized and directed to institute the necessary legal pro- ceedings in the name of said City in the exercise of its right of eminent domain for the condemnation of said property for said pur- pose, and that such condemnation proceedings be taken in accord- ance with the provisions and procedures as set forth in the Federal Open Space program, and the City ' s approved participating Federal Open Space grant authorization; BE IT FURTHER RESOLVED that this Resolution be adopted pur- suant to and in accordance with the opinion, order and judgment OFFICE OF CITY ATTORNEY-1130 WASHINGTONA ENUE-MIAMI BEACH, FLORIDA 33139 1 of the District Court of Appeal of Florida, Third District, in Cases Numbered 69-779 and 69-780. PASSED AND ADOPTED this 24th day of June, 1970. Vice-
