13058 RESOLUTION NO. 13058 WHEREAS, pursuant to existing statutory law, the Dade County Tax Assessor duly filed the County Tax Assessment Roll for the 1970 tax year, on July 1, 1970, and WHEREAS, said Tax Assessment Roll, according to official statements which have been widely publicized through all forms of news media, represents an average increase in the Tax Assessment Roll of not less than 32%, and WHEREAS, the taxpaying public was wholly unprepared and wholly unadvised by any source , official or otherwise , that such a drastic increase in the Tax Assessment Roll would be forthcoming, and WHEREAS, in accordance with statutory provisions , an ad valorem taxpayer is and was required to file his appeal from any increase in his ad valorem assessment on or before July 15, 1970 , and WHEREAS, said appeal period is completely inadequate and wholly fails to afford a reasonable opportunity to file an appeal from such increase in assessment with resultant deprivation of due process of law; NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that the Governor of the State of Florida, the Honorable Claude Kirk, be and he is hereby respectfully requested and petitioned by the City Council of the City of Miami Beach to take such steps as may be reasonably within his powers and authority to extend the time for the filing of appeals from increased tax assessments by aggrieved taxpayers , to August 1, 1970 , or, in the alternative, to exercise his constitutional power, prerogative and authority to convene the Legislature in emergency session for the purpose of amending the existing statutory provision for the filing of such appeals up to August 1, 1970 , or such other later date as the Legislature may duly advise . BE IT FURTHER RESOLVED BY THE CITY COUNCIL that appropriate copies of the Resolution be transmitted to the Governor of the State of Florida, Honorable Claude Kirk, and to each member of the House of Representatives and the Senate of the State of Florida representing Dade County. The adoption of the above and foregoing Resolution was moved by the Honorable Jay Dermer, Mayor of the City of Miami Beach, Florida.
