13114 RESOLUTION NO. 13114 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, PROVIDING FOR A SPECIAL ELECTION TO BE HELD ON NOVEMBER 2 , 1971. WHEREAS , an Initiative Petition, pursuant to the pro- visions of Section 26 of the Charter of the City of Miami Beach, Florida, has been duly presented to the City Council of the City of Miami Beach, Florida; and WHEREAS , the City Clerk-Finance Director of the City of Miami Beach, Florida, has duly certified to the City Council that she has examined and compared the signatures appear- ing on the official Registration books of the City of Miami Beach, with the majority of the signatures appearing on said Initiative Petition, and based upon such examination and com- parison, has found, and has duly certified to the City Council of the City of Miami Beach, Florida, that there is a total of at least 4,363 valid signatures appearing on said Petition; and has further certified that the total number of registrations as of the date of the service of said Initiative Petition was 42 , 013 ; and that the said number of 4, 363 valid signatures consti- tutes 10.38% of the registration of the City of Miami Beach, Florida, as of said date; and WHEREAS , said Initiative Petition requests the City Council to submit to the electorate of the City of Miami Beach, the following measure, to wit : "ORDINANCE NUMBER " BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA : SECTION 1 : That there is a pressing need for the City of Miami Beach to provide facilities to protect the health, safety and welfare of its citi- zens, and that such need can be met in part by the pro- viding of Emergency Service with a duly licensed physician to accompany all ambulance calls . SECTION 2 : That all calls for emergency treatment of persons of Miami Beach shall be responded to by such emergency squad as may be provided, with a licensed physician to be a part of such emergency squad. SECTION 3 : That there shall be included and provided on vehicles responding to emergency calls adequate lifesaving equipment to treat emergency heart patients and to evaluate the condition of such heart patients . SECTION 4 : That adequate equipment shall be acquired by the City of Miami Beach and adequate personnel shall be employed or contracted with to accomplish the lifesaving service necessary for emergency treatment of persons on Miami Beach. SECTION 5 : That all funds necessary to accomplish the pur- poses of this Ordinance shall be made available out of emergency funds and/or from the regular budget of the City of Miami Beach. -1- OFFICE OF CITY ATTORNEY-1130 WASHINGTON AVENUE-MIAMI BEACH, FLORIDA 33139 " SECTION 6 : The provisions of this Ordinance shall become operative and effective ninety (90) days after this Ordinance shall be ratified and ap- proved by a majority of the qualified electors voting in an initiative election to be held in the City of Miami Beach under applicable provisions of law and pur- suant to Section 26 of the Charter of the City of Miami Beach, Florida, and pursuant to the Election Laws of the City of Miami Beach, Florida. " and WHEREAS , the City Attorney having duly advised the City Council of the City of Miami Beach, Florida, that the said measure is such that the City Council of the City of Miami Beach, Florida, itself, must either adopt said measure without alteration, or submit the same to the electorate of the City of Miami Beach, Florida; NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA : SECTION 1 : That a Special Election be and the same is hereby called by the City Council of the City of Miami Beach, Florida, to be held on the 2nd day of November, 1971, for the purpose of submitting to the electorate of the City of Miami Beach, Florida, the measure hereinabove set forth, for approval or rejection by the electorate. SECTION 2 : The City Clerk-Finance Director, who is also the Supervisor of Registration, shall open the books of the said City of Miami Beach from 9 o'clock A.M. until 5 o 'clock P.M. from September 17, 1970, until October 2, 1971 , for the purpose of registering those voters who are qualified to register for this election, and after the 2nd day of October, 1971, no elector shall be registered for said election. SECTION 3 : For the purpose of holding and conducting the said Special Election, the City of Miami Beach, Florida, is divided into voting precincts or election districts, with polling districts as follows : (Here appears description of voting precincts and election districts and polling places) All places being where elections are usually held in said municipality. All electors shall vote at the Polling places in the voting precincts in which the City Registration Books show that said electors reside. -2- OFFICE OF CITY ATTORNEY-1130 WASHINGTON AVENUE-MIAMI BEACH, FLORIDA 33139 SECTION 4 : That thirty days ' notice of said election shall be given by publication in the MIAMI BEACH SUN, a newspaper of general circulation, published in the City of Miami Beach, Florida. Such publication shall be made at least once each week, for four consecutive weeks, during said period of thirty days. SECTION 5 : That the Notice of Election shall be substantially in the following form: "CITY OF MIAMI BEACH, FLORIDA NOTICE OF SPECIAL ELECTION "NOTICE IS HEREBY GIVEN that an Election has been called by the City Council of the City of Miami Beach, Florida, and will be held in said City from 7 :00 o'clock A.M. to 7 :00 o 'clock P.M. on the 2nd day of November, 1971, at which time there shall be submitted to the duly registered and qualified voters of said City, the following question : "SHALL THE FOLLOWING ORDINANCE BE ADOPTED : ORDINANCE NUMBER BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA : SECTION 1 : That there is a pressing need for the City of Miami Beach to provide facilities to protect the health, safety and welfare of its citizens, and that such need can be met in part by the providing of Emergency Service with a duly licensed physician to accompany all ambulance calls . "The Registration Books will be open from 9:00 o'clock A.M. until 5 :00 o'clock P.M. from September 17, 1970, until October 2, 1971 , for the registration of persons qualified to register for said election. City Clerk-Finance Director of the City of Miami Beach, Florida" SECTION 6: That the voting shall be on mechanical voting machines, unless otherwise provided by law. The form of ballot to be used in said election shall be in substantially the follow- ing form: "OFFICIAL BALLOT CITY OF MIAMI BEACH, FLORIDA SPECIAL ELECTION Shall the following Ordinance be adopted? (Here set out form of measure hereinabove set forth) MAKE A CROSS (X) AFTER YOUR CHOICE : FOR THE ORDINANCE AGAINST THE ORDINANCE SECTION 7 : This Resolution shall be effective immediately upon its passage and adoption, as required by law.
